Recognizing the termination of the employment of Wayne Cauthen as City Manager.

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

WHEREAS, on November 19, 2009 Wayne Cauthen was removed from office as City Manager by Mayor Mark Funkhouser and this action was ratified by the City Council on that day, all pursuant to Section 218(e)(1) of the City Charter; and

WHEREAS, although the employment contract of Wayne Cauthen provided for the termination of his employment at any time and for any reason the employment contract did not specify any specific means by which termination would occur; and

WHEREAS, the City Charter establishes the means by which a City Manager may be removed from office and that process was followed; and

WHEREAS, it is desirable to recognize the legal import of the action of the Mayor and City Council on November 19, 2009; NOW, THEREFORE

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

Section 1. That the Mayor and City Council, acting in their administrative capacity as appointing authority of the City Manager of the City of Kansas City, Missouri recognize the termination of the employment contract of Wayne Cauthen effective November 19, 2009.
