Amending Chapter 80, Code of Ordinances, by
adding a new section to be known as Section 80-11A0188, rezoning an area of
approximately 25.76 acres generally located north of Tiffany Springs Parkway,
south of proposed N.W. 101st Terrace and west of N.W. Skyview Avenue, from
Districts GP-1 (General Industry) and GP-3 (Regional Business) to District GP-4
(High Density Residential Uses), and approving a development plan for the
same. (6091-GP-10)
BE IT ORDAINED BY THE COUNCIL OF
KANSAS CITY:
Section A. That Chapter 80, Code of
Ordinances of the City of Kansas City, Missouri, 1996, commonly known as the
Zoning Ordinance, is hereby amended by enacting a new section to be known as
Section 80-11A0188, rezoning an area of approximately 25.76 acres generally
located north of Tiffany Springs Parkway, south of proposed N.W. 101st Terrace
and west of N.W. Skyview Avenue, from Districts GP-1 (General Industry) and
GP-3 (Regional Business) to District GP-4 (High Density Residential Uses), said
section to read as follows:
Section 80-11A0188. That an area
legally described as:
Part of Parcel 7, all of
Parcels 8 and 11, in Tiffany Centro, a subdivision of land in the Northeast
1/4 and the Southeast 1/4 of Section 36, as recorded in Document No. 36910, in
Book 11, at page 8; part of N. Avalon Avenue and all of the Southeast 1/4 of
said Section 36 lying northerly of Tiffany Springs Parkway, as dedicated in
Document No. 26148, in Book 683, at page 747, and lying easterly of Premier
Center, a subdivision of land recorded in Document No. 9902, in Book 18, at
page 178; all in Township 52 North, Range 34 West of the 5th Principal
Meridian, in Kansas City, Platte County, Missouri, more particularly described as
follows:
Beginning at the
northeast corner of the Southeast 1/4 of said Section 36, thence South
0042'33" West, (all bearings herein are referenced to the Missouri State
Plane Coordinate System 1983, West Zone) on the east line of said Southeast
1/4; 643.32 feet to the northerly right of way line of said Tiffany Springs
Parkway; thence South 7900'00" West on said northerly right of way line,
180.79 feet to a point of curvature; thence westerly on said northerly right of
way line on a curve to the right (said curve having a radius of 807.00 feet,
chord bearing of South 8430'00" West, chord distance of 154.70 feet) an
arc distance of 154.93 feet (deed and measured); thence South 9000'00"
West on said northerly right of way line, 118.58 feet (deed and measured) to a
point of curvature; thence westerly on said northerly right of way line on a
curve to the right (said curve having a radius of 807.00 feet, a chord bearing
of North 8627'19" West, chord distance of 99.79 feet) an arc distance of
99.85 feet to the southeast corner of said Premier Center; thence
northwesterly on the easterly line of said Premier Center on a curve to the
left (said curve having an initial tangent bearing of North 0408'44"
West, radius of 980.00 feet, chord bearing of North 2242'55" West, chord
distance of 624.18 feet) an arc distance of 635.24 feet (plat and measured);
thence North 5700'00" East on said easterly line, 38.51 feet
(plat and measured);
thence North 3300'00" West on said easterly line, 30.00 feet (plat and
measured); thence South 5700'00" West on said easterly line, 43.36 feet
(plat and measured); thence northwesterly on said easterly line on a curve to
the left (said curve having an initial tangent bearing of North 4303'42"

a tract of land recorded in Corporation Warranty Deed filed as Document No.
2969, in Book 729, at page 44; thence North 1241'39" East on said
easterly line and on the northerly extension of said easterly line, 394.46 feet
to the northerly line of said Parcel 7, said point also being on the southerly
right of way line of N.W. 101st Street Terrace; thence South 7156'01"
East on said northerly parcel line and said southerly right of way line, 28.94
feet to a point of curvature; thence easterly on said northerly parcel line and
on said southerly right of way line on a curve to the left (said curve having a
radius of 1250.00 feet, chord bearing of South 7539'21" East, chord
distance of 162.30 feet) an arc distance of 162.41 feet (plat and measured) to
the northeast corner of said Parcel 7 and the northwest corner of said Parcel
8; thence easterly on said southerly right of way line and on the northerly
line of said Parcel 8, continuing on said curve to the left (said curve having
an initial tangent bearing of South 7922'41" East, a radius of 1250.00
feet, chord bearing of South 8928'52" East, chord distance of 438.54
feet) an arc distance of 440.83 feet (plat and measured); thence North
8024'58" East on said southerly right of way line and on said northerly
parcel line, 117.51 feet (plat and measured) to the northeast corner of said
Parcel 8; thence continuing North 8024'58" East, on the easterly
prolongation of said southerly right of way line, 60.00 feet (plat and
measured) to the northwest corner of said Parcel 11; thence North
8024'58" East on the northerly line of said Parcel 11 and on said
southerly right of way line, 53.67 feet (plat and measured) to a point of
curvature; thence easterly on said northerly parcel line and on said southerly
right of way line on a curve to the right (said curve having a radius of
2150.00 feet, chord bearing of North 8514'29" East, chord distance of
361.71 feet) an arc distance of 362.13 feet (plat and measured); thence South
8956'00" East on said northerly parcel line and on said southerly right
of way line, 28.72 feet measured (33.79 feet plat) to the northeast corner of
said Parcel 11, said point also being on the east line of said Northeast 1/4;
thence South 0042'33" West on said east section line and on the east line
of said Parcel 11, 598.95 feet measured (601.99 feet plat) to the point of
beginning. (Tract contains 25.759 acres)
is hereby rezoned from
Districts GP-1 (General Industry) and GP-3 (Regional Business) to District GP-4
(High Density Residential Uses), all as shown outlined on a map marked Section
80-11A0188, which is attached hereto and made a part hereof, and which is
hereby adopted as a part of an amendment to the zoning maps constituting a part
of said chapter and as an amendment to Section 80-11 thereof.
Section B.
That a development plan for the area legally described above is hereby
approved, subject to the following conditions:
1. That
the developer cause the area to be platted and processed in accordance with
Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, as
amended, commonly known as the Subdivision Regulations.
2. That
the developer submit a storm drainage study for the entire development to the
City Engineers Office for approval and that the developer make any necessary
improvements as required by the City Engineers Office.
3. That
the developer submit plans for grading and siltation and erosion control to the
City Engineers Office for approval prior to beginning any construction
activities.
4. That
the developer dedicate additional right of way for N.W. 101st Terrace as
required by the Department of Public Works so as to provide 50 feet of right of
way as measured from the centerline of N.W. 101st Terrace.
5. That
the developer improve one-half of N.W. 101st Terrace to primary arterial street
standards as required by the Department of Public Works, including construction
of curb, gutter and sidewalks and installation of streetlights.
6. That
the developer dedicate additional right of way for Tiffany Springs Parkway as
required by the Department of Public Works so as to provide 60 feet of right of
way as measured from the centerline of Tiffany Springs Parkway.
7. That
the developer improve one-half of Tiffany Springs Parkway to primary arterial
street standards as required by the Department of Public Works, including
construction of sidewalks.
8. That
the developer extend water mains as required by the Water Services Department.
9. That
the developer provide for fire protection as required by the Fire Department
prior to construction beyond foundations.
10. That
the developer extend sanitary sewers as required by the Department of Public
Works.
11. That
the developer comply with the Kansas City International Airport Height Zoning
restrictions and that such restrictions be included on the final plat.
12. That
the developer grant an Aviation Noise Easement (for each phase) to the City and
file the same with each final plat as required by the Aviation Department.
13. That
the developer submit a Fair Disclosure Agreement as required by the Aviation
Department.
14. That
the developer secure a land disturbance permit from the Missouri Department of
Natural Resources.
15. That
the developer dedicate right of way for the north/south street along the entire
east boundary of the development plan as required by the Department of Public
Works so as to provide 30 feet of right of way for the north/south street.
16. That
the developer improve one-half of the north/south street along the entire east
boundary of the development plan to collector street standards as required by
the Department of Public Works.
17. That
the developer construct a temporary cul-de-sac at the east end of N.W. 101st
Terrace as required by the Department of Public Works.
18.
That the developer contribute $43,262.35 in lieu of parkland dedication
for 336 multi-family units (336 x 2 x 0.006 x $10,729.75) in satisfaction of
Section 66-128 of the Subdivision Regulations.
19. That
the developer secure the approval of the Street Naming Committee for all street
names.
20.
That the developer submit a final plan to the City Plan Commission for
approval, including plans for landscaping, grading and screening, prior to the
issuance of a building permit.
A copy of said development plan is on file in
the office of the City Clerk under Document No. 990580, which is attached
hereto and made a part hereof.
Section C. That the Council finds
and declares that before taking any action on the proposed amendment
hereinabove, all public notices and hearings required by the Zoning Ordinance
have been given and had.
