COMMITTEE SUBSTITUTE
FOR RESOLUTION NO. 090167
Authorizing the Director of
Aviation to submit a preliminary application to the FAA for participation of
KCI and Downtown Airports in the Airport
Privatization Pilot Program.
WHEREAS, the
City of Kansas City, Missouri (the City) is a constitutionally chartered
political subdivision of the State of Missouri; and
WHEREAS, the
City owns and operates Kansas City International Airport situated in Kansas
City, Platte County, Missouri (KCI) and Charles B Wheeler Downtown Airport
(Downtown Airport) situated in Kansas City, Clay County, Missouri; and
WHEREAS, the Airport Privatization Pilot Program, 49 U.S.C. Section
47134 (Program), authorizes the transfer of up to five
publically-owned airports to private operators and authorizes the Federal
Aviation Administration (FAA) to grant public airport owners like the City an
exemption to use proceeds from such transfers for non-airport purposes; and
WHEREAS, the
Program authorizes participation by one large hub airport such as Midway
Airport (for which a preliminary application has been filed), three medium hub
airports such as KCI and one general aviation airport such as Downtown Airport;
and
WHEREAS, the
Program, among other things, allows a private operator to earn reasonable
compensation; subjects a private operator to all FAA oversight and all federal
laws, rules and regulations; and requires that any collective bargaining
agreement that covers employees of the airport in effect on the date of the
sale or lease will not be terminated by the sale or lease; and
WHEREAS,
participation in the Program requires a Preliminary Application to the FAA,
public solicitation for a private operator and a Final Application to the FAA;
and
WHEREAS, the City desires to submit two Preliminary
Applications to the FAA, one for the privatization of KCI by lease to a
private operator; and one for the privatization of Downtown Airport by lease or
sale to a private operator; NOW, THEREFORE,
BE IT RESOLVED BY THE COUNCIL OF KANSAS CITY:
That the Director of Aviation is hereby authorized to (i)
submit a Preliminary Application to the Federal Aviation Administration for
participation of Kansas City International Airport in the Airport Privatization
Pilot Program, 49 U.S.C. Section 47134; and (ii) submit a Preliminary
Application to the Federal Aviation Administration for participation of Charles
B. Wheeler Downtown Airport in the Airport Privatization Pilot Program, 49
U.S.C. Section 47134
