Rezoning an area of approximately
8.5 acres generally located on the east side of N.W. Interurban Road, about
1850 feet north of N.W. 128th Street from District GP-7 to District GP-6 and
approving a development plan. (13330-GP-1)
BE IT ORDAINED
BY THE COUNCIL OF KANSAS CITY:
Section A. That
Chapter 80, Code of Ordinances of the City of Kansas City, Missouri, commonly
known as the Zoning Ordinance, is hereby amended by enacting a new section to
be known as Section 80-11A0681, rezoning an area of approximately 8.5 acres
generally located on the east side of N.W. Interurban Road, about 1850 feet
north of N.W. 128th Street from District GP-7 (Agricultural and Low Density
Residential) to District GP-6 (Low Density Residential), said section to read
as follows:
Section 80-11A0861. That an area
legally described as:
All that part of the West
one-half of the Southwest Quarter of Section 12, Township 52 North, Range 34
West of the 5th P.M., Platte County, Missouri lying North and East of
Interurban Road, as now established, and being more particularly described as
follows:
Commencing at the West Quarter Corner of said Section 12;
thence South 89 46'23" East, along the North line of the Southwest Quarter
of said Section 12, a distance of 457.36 feet to a point on the East
right-of-way for Interurban Road, as now established; thence South 36 22'
11" East, along said East right-of-way line, a distance of 212.63 feet to
the Point of Beginning; thence South 89 46'46" East, a distance of 743.73
feet, to a point on the East line of the West one-half of the Southwest Quarter
of said Section 12; thence South 00 28'34" West, along said East line, a
distance of 995.81 feet, to a point on the Northeasterly right-of way of said
Interurban Road; thence North 36 22'12" West, along said Northeasterly
right-of-way, a distance of 1240.23 feet, to the Point of Beginning and
containing 370,307 square feet or 8.501 acres, more or less.
is hereby rezoned from GP-7
(Agricultural and Low Density Residential) to District GP-6 (Low Density
Residential), all as shown outlined on a map marked Section 80-11A0681, which
is attached hereto and made a part hereof, and which is hereby adopted as a
part of an amendment to the zoning maps constituting a part of said chapter and
as an amendment to Section 80-11 thereof. A development plan for this property
is hereby approved subject to the following conditions:
1. That a variance
to the required 50 foot setback for the existing detached garage be granted.
2. That the
developer shall cause the area to be platted and processed in accordance with
Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, commonly
known as the Subdivision Regulations.
3. That the
developer submit a detailed micro storm drainage study, consisting at a minimum
of a letter from a Missouri Licensed Civil Engineer stating that the proposed
improvements will not alter or increase historical runoff conditions for the
site, to the City Engineers Office with the final plat application, and that
the developer construct any improvements as required.
4. That the
developer shall subordinate to the City all private interest in the area of any
right-of-way dedication as required and that the developer shall be responsible
for all costs associated with subordination activities.
5. That the
developer enter into a Noise Disclosure Agreement to provide a disclosure for
any real estate transaction as required by the Aviation Department.
6. That the
developer grant an Aviation Noise Easement to the City with the final plat as
required by the Aviation Department.
Section B. That
the Council finds and declares that before taking any action on the proposed
amendment hereinabove, all public notices and hearings required by the Zoning
Ordinance have been given and had.
