ORDINANCE NO. 961212

 

Approving the plat of Brookeshire - Third Plat, an addition in Kansas City, Clay County, Missouri; accepting and releasing various easements; establishing grades on public ways; accepting certain lands for park purposes forever, in accordance with Section 58 of Article III of the Charter of Kansas City.

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the plat of Brookeshire - Third Plat, a subdivision in Kansas City, Clay County, Missouri, a true and correct copy of which is attached hereto and incorporated herein by reference is hereby approved.

 

Section 2. That the plat granting and reserving unto Kansas City an easement and license or right to locate, construct, operate and maintain facilities including, but not limited to, water, gas, sewerage, telephone, cable TV, surface drainage, underground conduits, pad mounted transformers, service pedestals, any and all of them upon, over, under and along the strips of land outlined and designated on the plat by the words utility easement or U/E be and the same are hereby accepted and where other easements are outlined and designated on the plat for a particular purpose, be and the same are hereby accepted for the purpose as therein set out.

 

Section 3. That the grades of the streets and other public ways set out on the plat, herein accepted, are hereby established at the top of curb, locating and defining the grade points which shall be connected by true planes or vertical curves between such adjacent grade points, the elevations of which are therein given, in feet above the City directrix.

 

Section 4. That the lands heretofore designated and selected by the Board of Park and Recreation Commissioners as evidenced by their Resolution No. 23290 duly adopted on February 13, 1996, public use for park purposes to wit:

 

A tract of land lying in part of Lots 14, 15, and 16, Eureaka Farms, a subdivision of land in the Fractional Northwest Quarter of Section 22, Township 51, Range 33, Kansas City, Clay County, Missouri, being bounded and described as follows: Commencing at the northeast corner of said Fractional Northwest Quarter; thence South 89 26'06" West, along the north line of said Fractional Northwest Quarter, 616.77 feet to the true point of beginning of the tract to be herein described; thence South 70 49'02" West, 58.94 feet; thence South 71 10'09" West, 95.79 feet; thence North 89 34'27" West, 206.29 feet; thence South 58 05'34" West, 198.80 feet; thence South 9 4'36" East, 215.02 feet; thence South 71 01'34" East, 125.58 feet; thence South 8 07'58" West, 257.78 feet; thence South 6 39'43" East, 177.77 feet; thence North 72 33'14" East, 129.98 feet; thence southerly along a curve to the right, having an initial tangent bearing South 17 26'46" East, a radius of 390.00 feet; an arc distance of 121.12 feet; thence South 0 20'51" West, 66.65 feet, to a point on the north line of Westgate Meadows-Second Plat, a subdivision of land in Kansas City, Clay County, Missouri; thence North 89 40'14" West (P-North 89 42'00" West), 514.00 feet to the northwest corner of said Westgate Meadows-Second Plat, said point being also a point on the west line of said Lot 14, said point being also a point on the centerline of Line Creek, as now established; thence North 19 48'29" East, along said centerline, 73.23 feet; thence North 13 29'24" East, along said centerline, 114.58 feet; thence North 2 07'32" East, along said centerline, 100.78 feet; thence North 58 27'19" East along said centerline, 58.03 feet; thence South 62 49'34" East, along said centerline, 32.78 feet; thence South 25 19'40" West, along said centerline 57.35 feet; thence South 47 53'32" East, along said centerline, 44.59 feet; thence North 88 17'25" East, along said centerline, 104.70 feet; thence North 27 54'17" East, along said centerline, 124.08 feet; thence North 9 41'13" East, along said centerline, 114.64 feet; thence North 69 36'39" West, along said centerline, 207.50 feet; thence North 51 05'14" West, along said centerline, 149.29 feet; thence North 28 18'44" West, along said centerline, 146.87 feet; thence North 45 02'00" East, along said centerline, 71.72 feet; thence North 41 30'35" East, along said centerline, 144.51 feet; thence North 61 11'08" East, along said centerline, 51.97 feet; thence North 86 38'07" East, along said centerline, 127.22 feet; thence North 55 36'49" East, along said centerline, 53.51 feet; thence North 74 01'19" East, along said centerline, 76.95 feet to a point on the aforementioned north line of said Fractional Northwest Quarter; thence North 89 26'06" East, along said north line, 373.22 feet to the true point of beginning. Containing 5.87 acres, more or less.

 

Containing 5.87 acres, more or less be and the same is hereby accepted for public use for park purposes and shall remain such forever in accordance with Section 58 of Article III of the Charter of Kansas City.

 

Section 5. That the Council finds that the City Plan Commission has duly endorsed its approval of this Ordinance hereon.
