Approving the preliminary plat of Wornall Park Condos on a 0.364 acre tract of land generally located at the northwest corner of W. 45th Terrace and Wornall Road (4512, 4516, and 4518 Wornall Road). (SD 1191)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That the preliminary plat of Wornall Park Condos on a 0.364 acre tract of land generally located at the northwest corner of W. 45th Terrace and Wornall Road (4512, 4516, and 4518 Wornall Road), and more specifically described as follows:

 

Legal Description by Deed:

 

Tract I: (Quit Claim Deed No. K-978072) The South 3 feet of Lot 1, and all of Lot 2, except the South 13 inches of the East 120 feet thereof, Wornall Park, a subdivision in Kansas City, Jackson County, Missouri, according to the recorded plat thereof.

 

Tract II: (Warranty Deed No. K-118814) Lot 1, except the South 3 feet, Wornall Park, a subdivision in Kansas City, Jackson County, Missouri, according to the recorded plat thereof, and the South 10 feet of Lot 20, Forest Grove, a subdivision in Kansas City, Jackson County, Missouri, according to the recorded plat thereof.

 

Tract III: (Currently Owned by Others) The West 10 feet and all of the East 120 feet of Lot 3, Wornall Park, also the South 13 inches of the East 120 feet of Lot 2, Wornall Park, a subdivision in Kansas City, Jackson County, Missouri, according to the recorded plat thereof.

 

Surveyors Suggested Legal Description:

 

All of Lots 1, 2 and 3 of Wornall Park, together with the South 10 feet of Lot 20, of Forest Grove, each being a subdivision in Kansas City, Jackson County, Missouri, according to the recorded plats thereof in the Northwest Quarter of Section 29, Township 49 North, Range 33 West and being more particularly described as follows: Beginning at the Southeast Corner of said Lot 3, being also the intersection of the North right-of-way line of 45th Street Terrace with the Westerly right-of-way line of Wornall Road as said Terrace and Road are now both established; thence North 87 degrees 34 minutes 06 seconds West along the North right-of-way line of said 45th Street Terrace, a distance of 130 feet to the Southwest corner of said Lot 3; thence North 13 degrees 05 minutes 29 seconds West along the Westerly line of said Lots 3, 2 and 1 and no longer along said North right-of-way line, a distance of 112.98 feet (112.96 feet, Plat) to the Northwest corner of said Lot 1, being also a point on the South line of said Lot 20; thence North 87 degrees 34 minutes 06 seconds West along the South line of said Lot 20, a distance of 42.12 feet to the Southwest corner of said Lot 20; thence North 02 degrees 23 minutes 36 seconds East along the West line of said Lot 20, a distance of 10 feet to a point 10 feet North of the South line of said Lot 20, as measured perpendicular to the South line thereof; thence South 87 degrees 34 minutes 06 seconds East along a line 10 feet North of and parallel with the South line of said Lot 20, a distance of 169.35 feet to a point on the Easterly line of said Lot 20, being also a point on the Westerly right-of-way line of said Wornall Road; thence South 13 degrees 05 minutes 29 seconds East along said Westerly right-of-way line and along the Easterly line of said Lots, 20, 1, 2 and 3, a distance of 123.36 feet to the Point of Beginning. Containing 15,859 square feet or 0.364 acres, more or less.

 

The following described tract of land is proposed to be transferred through certificate of survey and removed from the above described Surveyors Suggested Legal Description:

 

The South 10 feet of Lot 20, Forest Grove, a subdivision in Kansas City, Jackson County, Missouri, according to the recorded plat thereof. Containing 1,707 square feet or 0.039 acres, more or less

 

is hereby approved, subject to the following conditions:

 

1.                  That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of Kansas City, Missouri, commonly known as the Subdivision Regulations.

 

2.                  That the developer secure permits to repair sidewalks, curbs and gutters as necessary along the development street frontage as required by the City Development Departments Development Services group in accordance with Chapters 56 and 64, Code of Ordinances, prior to recording of the plat.

 

3.                  That the developer submit plans for grading and siltation and erosion control to the City Development Departments Development Services group for approval prior to beginning any construction activities.

 

4.                  That the developer submit covenants, conditions and restrictions to the Law Department for approval for the maintenance of common areas.

 

5.                  That the developer receive the approval of the Board of Zoning Adjustment for any necessary variances, as needed.

 

6.                  That the developer receive the approval of the Board of Zoning Adjustment for a conditional use permit to allow for any proposed signage advertising the name and or use of the property.

 

7.                  That the developer submit a detailed micro storm drainage study, consisting at a minimum of a letter from a Missouri Licensed Civil Engineer stating that the proposed improvements will not alter or increase historical runoff conditions for the site, to the City Development Departments Development Services group prior to approval and issuance of any building permits, and that that the developer construct any improvements, as required by the Development Services Division.

 

8.                  That the developer contribute $1,195.39 in-lieu-of parkland dedication for 10 multi-family units in satisfaction of Section 66-128 of the Subdivision Regulations at a rate of $9,961.61, per acre.

 

9.                  That a 5-foot variance to the minimum required right-of-way width of 25 feet from center line for a residential local street is hereby granted to allow for an access level street with a minimum right-of-way of 20 feet from center line as shown on the preliminary plat.

 

A copy of the preliminary plat is on file in the office of the City Clerk with this ordinance and is made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed preliminary plat hereinabove, all public notices and hearings required by the Subdivision Regulations have been given and had.
