ORDINANCE NO. 900461
Approving an Amendment to the Ground Lease between the
City and 8400 Partners, L.P., assignee, and authorizing the Director of Finance
to execute the Lease and the Memorandum of Lease; releasing certain easements;
accepting certain sanitary and storm sewer and drainage easements for property
identified as 8320 Ward Parkway.
BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:
Section 1. That a First Amendment to Lease
Agreement between the City and 8400 Partners, L.P., for certain property
located generally at 8320 Ward Parkway, a copy of which amendment is attached
hereto and incorporated herein by reference, is hereby approved and the
Director of Finance is hereby authorized to execute the First Amendment to
Lease Agreement (Exhibit "A") as well as the First Amendment to
Memorandum of Lease, a copy of which is attached hereto as Exhibit
"B".
Section 2. That the City hereby accepts a standard
sewer easement for storm water, sanitary sewer and drainage purposes for an
area generally located at 8320 Ward Parkway. A copy of said easements are
attached hereto and incorporated herein by reference as Exhibit "C",
"D", and "E".
Section 3. That the City hereby releases a portion
of a 35 foot sewer and drainage easement as shown on Lot 1, Ward Parkway Office
Park North, Second Plat, a subdivision in Kansas City, Jackson County, more
specifically described as:
All of the south 11 feet of the north 35 feet of the
west 107.50 feet of Lot 1 and also all of the south 4 feet of the
north 35 feet of the east 16 feet of the west 123.50 feet of said Lot 1,
all in Ward Parkway Office Park North, 2nd Plat, a subdivision of land in
Kansas City, Jackson County, Missouri.
Section 4. That the City releases a certain utility
easement more specifically described as follows:
All that part of the utility easement as reserved
in Vacation Ordinance No. 54981, as recorded in Book K-1210 at page
1896, in the Office of the Recorder of Deeds, Jackson County, Missouri,
that lies within Lot 2, WARD PARKWAY OFFICE PARK NORTH, SECOND PLAT, a
subdivision of land in Kansas City, Jackson County, Missouri, being
the East 20 feet of the West 122 feet of the North 260 feet except
the North 25 feet of said Lot 2, and being the East 20 feet of the West
142 feet of the South 135 feet of the North 260 feet of said Lot 2.
Section 5. That the City releases a certain utility
easement more specifically described as follows:
All that part of the utility easement reserved
in Vacation Ordinance No. 54981, as recorded in Book K-1210 at page
1896, in the Office of the Department of Records, Jackson County,
Missouri, that lies within the south 100 feet of Lot 1, WARD PARKWAY
OFFICE PARK NORTH, SECOND PLAT, a subdivision of land in Kansas City,
Jackson County, Missouri, being the West 20 feet of the South 100
feet of said Lot 1.
Section 6. That the City Clerk is hereby directed
to cause a copy of the First Amendment to Memorandum of Lease and Exhibits
"C", "D", and "E" to be recorded in the Office of
the Department of Records of Jackson County, Missouri and also to cause to be
recorded a Notice of Release of Easements, a copy of which is attached hereto
as Exhibit "F".
