ORDINANCE NO. 190281

 

Vacating an alley generally located on the north side of Admiral Boulevard in between Interstate 35 to the west and Forest Avenue to the east; and directing the City Clerk to record certain documents. (CD-ROW-2018-00121)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the Council of Kansas City does hereby find and declare that on the 20th day of November, 2018, a petition was filed with the City Clerk of Kansas City by BHC Rhodes for the vacation of a tract of land being a part of a publicly dedicated alley, to be vacated, in Block A, Ranson & Tally’s Addition, a subdivision in the City of Kansas City, Jackson County, Missouri, recorded in Plat Book 1 at Page 17, and being more particularly described by metes and bounds as follows: (Note: For course orientation, the bearings in this description are based on the North Right-of-Way line of Admiral Boulevard having a bearing of North 87 degrees 34 minutes 03 seconds West, as determined by Global Positioning System observations, and referenced to the Missouri State Plane Coordinate System, West Zone, NAD83.) Beginning at the Southwest corner of Lot 10, of said Block A; thence North 87 degrees 34 minutes 03 seconds West 15.00 feet, on the North Right-of-Way line of Admiral Boulevard, to the Southeast corner of Lot 11, of said Block A; thence North 02 degrees 08 minutes 28 seconds East 215.38 feet, on the East line of Lots 11, 12, 13, 14, and 15 of said Block A, to a point on the Southeasterly Right-of-Way line of U.S. Route 40 (Midtown Freeway), said point being 15.38 feet North of the Southeast corner of said Lot 15; thence South 86 degrees 07 minutes 05 seconds East 15.01 feet, on said Southeasterly Right-of-Way line, to a point on the West line of Lot 6, said Block A, said point being 15 feet North of the Southwest corner of said Lot 6; thence South 02 degrees 08 minutes 28 seconds West 215.00 feet, on the West line of Lots 6, 7, 8, 9 and 10 of said Block A, to the point of beginning of the Tract herein described, containing 3,229 square feet or 0.0739 acres more or less, giving the distinct description of the tract of land to be vacated, and also the names of the persons and corporations owning or claiming to own the property fronting thereon, and that the consent of the persons and corporations owning or claiming to own three-fourths of the front feet of the property immediately adjoining said tract of land has been obtained in writing, that said consent has been acknowledged as deeds are acknowledged, and was duly filed with the petition for such vacation in the City Clerk's Office.

 

Section 2. That the Council finds that the City Plan Commission has duly endorsed its approval of this Ordinance hereon.

 

Section 3. That the Council finds that no private rights will be unreasonably injured or endangered by this vacation and that the public will suffer no unreasonable loss or inconvenience thereby.

 

Section 4. That a tract of land being a part of a publicly dedicated alley, to be vacated, in Block A, Ranson & Tally’s Addition, a subdivision in the City of Kansas City, Jackson County, Missouri, recorded in Plat Book 1 at Page 17, and being more particularly described by metes and bounds as follows: (Note: For course orientation, the bearings in this description are based on the North Right-of-Way line of Admiral Boulevard having a bearing of North 87 degrees 34 minutes 03 seconds West, as determined by Global Positioning System observations, and referenced to the Missouri State Plane Coordinate System, West Zone, NAD83.) Section 5. That the City Clerk of Kansas City, Missouri, be and she is hereby authorized and directed to acknowledge this ordinance as deeds are acknowledged, and to cause this ordinance and the consent of property owners hereinbefore referred to, to be filed for record in the Recorder's Office in Jackson County, Missouri.

 

Section 6. All Ordinances or parts of Ordinances in conflict with this Ordinance are, in so much as they conflict with this Ordinance, hereby repealed.
