ORDINANCE NO. 080776

 

Enacting a new Section 40-461.5, Code of Ordinances, entitled Same - Classification of wireless customers to clarify that wireless telecommunications providers may rely upon existing customer classifications when determining the appropriate license fee rate.

 

WHEREAS, the City has reached agreement with three major wireless communications providers on the payment of the Citys occupational license fees; and

 

WHEREAS, the City has been requested to expressly approve the classification of customers for payment of the occupational license fees according to the current accounting practices of the providers; and

 

WHEREAS, the City has always presumed this continued classification; and

 

WHEREAS, to reassure wireless providers of the continued understanding of the classification of customers the City will amend its Code of Ordinances; NOW, THEREFORE

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That a new Section 40-461.5, code of ordinances, is enacted to read as follows:

 

Sec. 40-461.5. Same Classification of wireless customers.

 

For purposes of section 40-460, Telephone businesses generally and section 40-461, Same Emergency tax in determining whether a particular customer or service address is residential or business, a wireless telecommunications company may rely upon existing customer classifications in its books and records, kept in the ordinary course of business, such as individual, customer, enterprise, business, corporate, non-residential, or government.
