COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 190291

 

Authorizing the Manager of Procurement Services to execute a $3,200,000.00 contract with Heartland Center for Behavioral Change, a Missouri Nonprofit Corporation, to house KCPD arrestees and detainees and to provide housing, assessment, re-entry and rehabilitation services for City inmates and detainees; authorizing the Manager of Procurement Services to amend and extend the contract with such additional funds that are appropriated for such purpose; waiving the requirements of Section 50-1, Private detention facilities; appropriating $286,000.00 from the Unappropriated Fund Balance of the General Fund; and recognizing an accelerated effective date.

 

WHEREAS, since 2014, the City and KCPD house City inmates and detainees and KCPD arrestees and detainees at the Jackson County Regional Correction Center under an Intergovernmental Cooperative Agreement (“Agreement”); and

 

WHEREAS, on June 22, 2018, Jackson County notified the City and KCPD that Jackson County was terminating the Agreement on June 25, 2019; and

 

WHEREAS, Jackson County’s termination of the Agreement has necessitated the City to have short-term and long-term transition plans to house City inmates and detainees and KCPD arrestees and detainees; and

 

WHEREAS, this contract will provide a short-term housing solution for KCPD arrestees and detainees and City inmates and detainees (a total of 110 beds) while the City and KCPD develop long term solutions; and

 

WHEREAS, in addition to housing KCPD arrestees and detainees and City inmates and detainees, Heartland will also provide assessment, re-entry and rehabilitation services; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the Manager of Procurement Services is authorized to execute a $3,200,000.00 contract with Heartland Center for Behavioral Change, a Missouri Nonprofit Corporation, to house KCPD arrestees and detainees and to provide housing, assessment, re-entry and rehabilitation services for City inmates and detainees. A copy of the contract in substantial form is on file in office of the Manager of Procurement Services.

 

Section 2. That the Manager of Procurement Services is authorized to amend and extend the contract with such additional funds that are appropriated for such purpose without additional City Council authorization.

 

Section 3. That the Council waives the permit requirements imposed by Section 50-1, Code of Ordinances, entitled “Private detention facilities” for this Contract and the Contractor.

 

Section 4.  That the sum of $286,000.00 is hereby appropriated from the Unappropriated Fund Balance of the General Fund to the following account in the General Fund:

 

19-1000-272210-B-619080 Correctional Services $286,000.00

 

Section 5. That this ordinance, relating to the appropriation of money, is recognized as an ordinance with an accelerated effective date as provided by Section 503(a)(3)(C) of the City Charter and shall take effect in accordance with Section 503, City Charter.
