ORDINANCE NO. 920495

 

Submitting to the qualified electors of Kansas City, Missouri, at the next election to be held not less than sixty days after the passage of this ordinance, August 4, 1992, an amendment to the Charter adopted February 24, 1925, as amended, repealing Section 61 and adopting in lieu thereof a new Section 61 entitled "Vehicle License Taxes".

 

WHEREAS, additional funds are required to provide for the adequate maintenance, adornment, construction, repair and operation of the City's parks, parkways, boulevards, community centers and other properties under the control of the management of the Board of Parks and Recreation Commissioners; and

 

WHEREAS, the Board of Parks and Recreation Commissioners by Resolution No. 21805 has requested that the Council submit to the voters of Kansas City a proposition amending Section 61 of the duly adopted City Charter and enacting a new Section 61 entitled "Vehicle License Taxes" in lieu thereof; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That at the next election to be held in Kansas City, Missouri, not less than sixty days after the passage of this ordinance, August 4, 1992, there shall be submitted to the qualified electors a proposed amendment to the Charter, adopted February 24, 1925, as amended, which proposal shall read as follows:

 

CHARTER AMENDMENT LISTING THE PURPOSES FOR WHICH VEHICLE LICENSE TAXES MAY BE EXPENDED.

 

BE IT ADOPTED BY THE PEOPLE OF KANSAS CITY:

 

Section (a) That the Charter of Kansas City, Missouri, adopted February 24, 1925, as amended, be amended by repealing Section 61, relating to vehicle license tax expenditures and adopting in lieu thereof a new section to be known as Section 61, Vehicle License Taxes, said Section to read as follows:

 

Section 61. Vehicle License Taxes.

 

Subject to the right of the Council to appropriate not to exceed three percent (3%) thereof to the Firemen's pension fund, all sums derived from license taxes collected by the City for licenses upon all vehicles of every kind and class licensed by the City shall be appropriated and used exclusively for collection service charges, maintaining, operating, adorning, constructing, repairing, renovating and otherwise improving the parks, parkways, boulevards, highways or other facilities, or portions thereof, which belong to the City, and are under the control and management of the Board of Park and Recreation Commissioners; and it shall be the duty of the Director of Finance from time to time as said license taxes are collected and paid into the City Treasury to apportion and credit the same to the funds of the respective park districts. Each park district shall receive such proportion of the vehicle license taxes as the total area of the parks, parkways, boulevards and facilities in such district bears to the total area to all parks, parkways, boulevards and facilities in the entire City.

The voter who desires to vote in favor of the Charter amendment shall place an X in the box opposite YES. The voter who desires to vote against the proposition shall place an X in the box opposite NO.

 

Section (b) This amendment shall take effect immediately upon adoption.

 

 

Section B. The City Clerk shall deliver to the Board of Election Commissioners of Kansas City, Missouri, to the Board of Election Commissioners of Clay County, Missouri, to the Clerk of the County Court of Platte County, Missouri, to the Clerk of the County Court of Cass County, Missouri, each a certified copy of this ordinance which shall be the authority for the respective election authorities of said City to conduct an election, provide the ballot labels and ballots therefor, and give notice thereof according to law and certify the results thereof.

 

Section C. This Ordinance providing for the submission of a proposal to the people, is recognized to be an emergency measure within the provisions of Section 15, Article II of the Charter and shall take effect immediately upon passage.
