ORDINANCE NO. 080236

 

Releasing and abating sanitary sewer special tax assessments of the City upon property owned by Kemp Estates, LLC in the vicinity of N.E. 95th Terrace and N. View Crest Drive.

 

WHEREAS, the Council authorized construction of a special assessment sewer in Ordinance No. 041255 and the collection of the special assessments in Ordinance No. 060317; and

 

WHEREAS, the current property owner is proposing a townhouse development on 7 lots that are not well served by the special assessment sewer in Sewer District 22067 due to elevation differences and conflicts with other utilities; and

 

WHEREAS, the property owner is proposing to construct, at his expense, a new sewer to serve the proposed development; and

 

WHEREAS, given the conflicts that exist with the existing sewer and the willingness of the owner to construct, at his expense, a new sewer, the City Council believes it would be in the best interests of the City to discharge and waive collection of the said portion of the special assessment tax bill on the Collection Sewer serving Sewer District No. 22067, as described below; NOW, THEREFORE,

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

  Section 1. That the Council hereby determines that a public benefit would be gained by the discharge of Special Assessment IDs 37001, 37003, 37004 through 37008, (Assessment Type PWSA) in the total original principal amount of $56,849.24 and issued by the City pursuant to Ordinance No. 060317 on February 1, 2007 upon the following properties owned by the Kemp Estates, LLC within Sewer District 22067:

1. Property at 9497 N. View Crest Drive, Clay County ID No. 13305000300100 and Plat and Parcel No. 318-5385-00-6-01, and legally described as:

A tract of land part of the East half of the West half of the Northwest quarter of Section 2, Township 51, Range 33, Kansas City, Clay County, Missouri, described as follows: Beginning at the Southeast corner of the East half of said West half; thence North 0 14 21 West along the East line of the East half of said West half 1933.3 feet to a point 15 feet more or less North of the centerline of Craig Road; thence westerly along a line 15 feet north of the Centerline of said road 548.82 feet to the east end of the strip taken for highway; thence South 0 17 14 East along the Right-of-Way line 45feet; thence West along the Right-of-Way 137.25 feet to a
point on the West line of the East half of the West half of the NW quarter; thence South O 19 4 East along said West line 2025.57 feet to the Southwest corner; thence East along the South line of the Northwest quarter 647.83 feet to the point of beginning. Except that part in Craig Road and except streets in Lakeview Acres, a subdivision in Kansas City, Clay County, Missouri.

2. No address, Clay County ID No. 13305000300200 and Plat and Parcel No. 318-5385-00-6-02, and legally described as:

Lot 14, Lakeview Acres, a subdivision in Kansas City, Clay County, Missouri

3. Property at 9423 N. View Crest Drive, Clay County ID No. 13305000300300 and Plat and Parcel No. 318-5385-00-6-03, and legally described as:

Lot 13, Lakeview Acres, a subdivision in Kansas City, Clay County, Missouri

4. Property at 9401 N. View Crest Drive, Clay County ID No. 13305000300400 and Plat and Parcel No. 318-5385-00-6-04, and legally described as:

Lot 12, Lakeview Acres, a subdivision in Kansas City, Clay County, Missouri

5. Property at 9251 N. View Crest Drive, Clay County ID No. 13305000300500 and Plat and Parcel No. 318-5385-00-6-05, and legally described as:

Lot 11, Lakeview Acres, a subdivision in Kansas City, Clay County, Missouri

6. Property at 9225 N. View Crest Drive, Clay County ID No. 13305000300600 and Plat and Parcel No. 318-5385-00-6-06, and legally described as:

Lot 10, Lakeview Acres, a subdivision in Kansas City, Clay County, Missouri

7. Property at 9215 N. View Crest Drive, Clay County ID No. 13305000300700 and Plat and Parcel No. 318-5385-00-6-07, and legally described as:

Lot 9, Lakeview Acres, a subdivision in Kansas City, Clay County, Missouri


Section 2. That the Council, pursuant to the authority of Section 818 of the City Charter to release a tax burden as otherwise provided by law does hereby release, abate and discharge said special assessment tax bill, including all accrued interest, penalties and costs thereon.
