ORDINANCE NO. 021406

 

Amending Chapter 80, Code of Ordinances, by adding a new section to be known as Section 80-11A0451, rezoning an area of approximately 3.53 acres generally located at 1504 N.W. Vivion Road from District RA (Agricultural) to District M-1-p (Light Industry - Limited District), and approving a preliminary plan for the same. (12848-P)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Chapter 80, Code of Ordinances of the City of Kansas City, Missouri, commonly known as the Zoning Ordinance, is hereby amended by enacting a new section to be known as Section 80-11A0451, rezoning an area of approximately 3.53 acres generally located at 1504 N.W. Vivion Road from District RA (Agricultural) to District M-1-p (Light Industry - Limited District), said section to read as follows:

 

Section 80-11A0451. That an area legally described as:

 

All that part of the Southwest Quarter of Section 34, Township 51, Range 33, Kansas City, Clay County, Missouri, described as follows: Beginning at a point 1159.80 feet north of the south line and 974.80 feet west of the east line of said Quarter Section, said point being the southwest corner of Eastbrook Business Park, a subdivision in Kansas City, Clay County, Missouri; thence North 89E30'40" West, parallel to the south line of said Quarter Section, a distance of 357.52 feet; thence North 19E09'20" East, a distance of 100.30 feet; thence North 07E06'10" East, a distance of 173.16 feet; thence North 04E09'20" East, a distance of 196.35 feet to the southwesterly right of way line of Interstate Highway No. 29; thence South 52E35'02" East along said right of way line, a distance of 15.84 feet; thence continuing along said right of way line South 88E41'35" East, a distance of 173.91; thence continuing along said right of way line South 58E17'40" East, a distance of 100.00 feet; thence continuing along said right of way South 47E25'33" East, a distance of 134.88 feet to the northwest corner of said Eastbrook Business Park; thence South 14E53'14" West along the westerly line of said Eastbrook Business Park, a distance of 318.75 feet to the point of beginning. Said tract contains 3.53 acres more or less.

 

is hereby rezoned from District RA (Agricultural) to District M-1-p (Light Industry - Limited District), all as shown outlined on a map marked Section 80-11A0451, which is attached hereto and made a part hereof, and which is hereby adopted as a part of an amendment to the zoning maps constituting a part of said chapter and as an amendment to Section 80-11 thereof.

 

Section B. That a preliminary plan for the area legally described above is hereby approved, subject to the following conditions:

 

1. That the developer submit a storm drainage study to the City Engineers Office for approval prior to issuance of building permits for the parking facilities and that the developer make any necessary improvements as required by the City Engineers


Office.

 

2. That the developer submit plans for grading and siltation and erosion control to the City Engineers Office for approval prior to the commencement of any construction activities.

 

3. That the developer secure a land disturbance permit from the Department of Public Works prior to beginning any construction, grading, clearing or grubbing activities, if the disturbed area exceeds one acre.

 

5. That the developer submit a final plan to the City Plan Commission for approval, including detailed information on grading, landscaping, lighting, fencing and signage (including elevations).

 

A copy of said preliminary plan is on file in the office of the City Clerk under Document No. 021406, which is attached hereto and made a part hereof.

 

Section C. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
