ORDINANCE NO. 960130
Authorizing the Director of Public Works, on behalf of
the City, to enter into a Private Road Crossing and Encroachment Agreement with
the Missouri Pacific Railroad Company, relating to the construction, operation
and maintenance of an improved Blue River Channel on Tract 115A of the Blue
River Channel Improvement Project; and authorizing the funding thereof.
WHEREAS, the Council finds that it did, by
Resolution No. 44436, passed September 13, 1974, reaffirm Kansas City's intent
to remain the local sponsor of the Blue River Improvement Project and agreed to
acquire right-of-way and access to that right-of-way as necessary for said
project, the agreement herein authorized promotes said resolution and intent;
NOW, THEREFORE,
BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:
Section 1. That the Director of Public Works is
hereby authorized to enter into and execute, on behalf of the City, a Private
Road Crossing and Encroachment Agreement with the Missouri Pacific Railroad
Company, a wholly owned subsidiary of the Union Pacific Railroad Company,
relating to the construction, operation, and maintenance of an improved Blue
River Channel on Tract 115A of the Blue River Channel Improvement Project. The
agreement shall be essentially in the form which is attached and incorporated
herein by reference.
Section 2. That the Director of Public Works is
hereby authorized to expend the sum of $7,000.00 from funds heretofore
appropriated to Account No. 95-393-089-7704T as and for consideration in the
aforesaid agreement.

I hereby certify that there is a balance, otherwise
unencumbered, to the credit of the appropriation to which the foregoing
expenditure is to be charged, and a cash balance, otherwise unencumbered, in
the treasury, to the credit of the fund from which payment is to be made, each
sufficient to meet the obligation hereby incurred.
