COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 080601

 

Approving the Sixth Amendment to the Development Plan submitted by the Wild Hawk, L.L.C. for the Front Street and 435 353 Project generally located on approximately 17 acres within an 80 acre project at the southwest corner of Front Street and Century Avenue and authorizing the Director of Finance to enter into an Assignment and Assumption Agreement between the City of Kansas City, Missouri, Front Street and 435 Redevelopment Corporation and Wild Hawk, L.L.C. and a First Amendment to the Sixth Supplementary Contract between the City of Kansas City, Missouri and Wild Hawk, L.L.C. (366-S-6)

 

 

WHEREAS, the Front Street and 435 Redevelopment Corporation, an urban redevelopment corporation of Missouri, organized under and pursuant to the Urban Redevelopment Corporations Act of 1945, as amended, did on July 29, 1987, file with the City Clerk an application for approval of a development plan (Development Plan) which was approved by Ordinance No. 61632, passed October 2, 1987; and

 

WHEREAS, the Front Street and 435 Redevelopment Corporation filed its First Amendment to the Development Plan which was approved by Ordinance No. 62985, passed September 8, 1988; and

 

WHEREAS, the Front Street and 435 Redevelopment Corporation filed its Second Amendment to the Development Plan which was approved by Ordinance No. 65496, passed May 17, 1990; and

 

WHEREAS, the Front Street and 435 Redevelopment Corporation filed its Third Amendment to the Development Plan which was approved by Ordinance No. 921109, passed October 15, 1992; and

 

WHEREAS, the Front Street and 435 Redevelopment Corporation filed its Fourth Amendment to the Development Plan which was approved by Ordinance No. 961262, passed October 17, 1996; and

 

WHEREAS, the Front Street and 435 Redevelopment Corporation filed its Fifth Amendment to the Development Plan which was approved by Ordinance No. 010017, passed February 15, 2001; and

 

WHEREAS, the Front Street and 435 Redevelopment Corporation desires to assign its rights in the development of Phase IIa of the Development Plan which requires City Council approval; and

 

WHEREAS, the Wild Hawk, LLC, developer of Phase IIa of the Development Plan (Developer) desires to amend the Development Plan to extend the dates for the commencement and completion of Developers Stage IIa construction obligations and amend the size of the building within proposed Phase IIa; and


WHEREAS, legal notice of a public hearing on the proposed Sixth Amendment to the Development Plan was published on April 15, 2008; and

 

WHEREAS, the City Plan Commission held a public hearing on the Sixth Amendment to the Development Plan on May 7, 2008; and

 

WHEREAS, at the public hearing conducted by the City Plan Commission, all interested parties were given an opportunity to be heard at said public hearing; and

 

WHEREAS, the City Plan Commission has made a study and investigation of the proposed Sixth Amendment to the Development Plan and, on May 7, 2008, recommended approval of the Sixth Amendment to the Development Plan and submitted a report of the same, a copy of which is attached hereto and incorporated herein by reference as Exhibit A; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the assignment of the development rights from the Front Street and 435 Redevelopment Corporation to Wild Hawk, L.L.C. are hereby approved and the Director of Finance is hereby authorized, on behalf of the City, to enter into an Assignment and Assumption Agreement with the Corporation and Wild Hawk, L.L.C., a copy of which in substantial form is attached hereto as Exhibit B.

 

Section 2. That the application for approval of a Sixth Amendment to the Development Plan by Wild Hawk, L.L.C. for the Front Street and 435 353 Redevelopment Plan, a copy of which is on file in the office of the City Clerk with this ordinance and is hereby incorporated by reference, is approved as a Sixth Amendment to the Development Plan as originally approved by Ordinance Nos. 61632, 62985, 65496, 921109, 961262, and 010017.

 

Section 3. That the Council hereby finds and declares that good cause has been shown for the approval of said Sixth Amendment to the Development Plan of the Wild Hawk, L.L.C. and that the findings and declarations set forth in Section 2 of Ordinance No. 61632 with respect to the development plan of the Front Street and 435 Redevelopment Corporation have not been effected by the amendment thereto and equally apply to said development plan, as amended.

 

Section 4. That the Council hereby finds and determines that the public convenience and necessity will be served by the development plan, as amended.

 

Section 5. That the Director of Finance is hereby authorized, on behalf of the City, to enter into a First Amendment to the Sixth Supplementary Contract with the Wild Hawk, L.L.C., a copy of which in substantial form is attached hereto as Exhibit C and incorporated herein by reference.
