ORDINANCE NO. 970120
Amending Chapter 80, Code of Ordinances of the City of
Kansas City, Missouri, 1996, commonly known as the Zoning Ordinance, by adding
a new section to be known as Section 80-11A0026, rezoning an area of
approximately 1.43 acres generally located at 12309-19 State Line Road from
District C-1 (Neighborhood Retail Business) to District C-2-p (Local Retail
Business - Limited District), and approving a preliminary plan for the same.

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:
Section A. That Chapter 80, Code of Ordinances of
the City of Kansas City, Missouri, 1996, commonly known as the Zoning
Ordinance, is hereby amended by enacting a new section to be known as Section
80-11A0026, rezoning an area of approximately 1.43 acres generally located at
12309-19 State Line Road from District C-1 (Neighborhood Retail Business) to
District C-2-p (Local Retail Business - Limited District), said section to read
as follows:
Section 80-11A0026. That an area legally described
as:
A parcel of land in Section 18, Township 47 North,
Range 33 West in Kansas City, Jackson County, Missouri, described as
follows: Commencing 891.00 feet south of the northwest corner of Section
18 and on the west line thereof; (bearings and distances based on Torres
Consulting, certificate of survey date April 18, 1991); thence North 61
15'08" East along the south line of that tract described in Book U at
page 453, a distance of 235.79 feet to the point of beginning; thence
North 10 00'21" West, 139.94 feet; thence North 75 31'19" West,
126.05 feet to the east right of way line of State Line Road; thence North
00 05'14" East along said right of way line, 255.09 feet; thence
South 86 31'09" East, 200.37 feet; thence South 00 02'48" West,
382.75 feet; thence South 61 15'08" West, 61.27 feet to the point of
beginning. Containing 1.43 acres.
is hereby rezoned from District C-1 (Neighborhood Retail
Business) to District C-2-p (Local Retail Business - Limited District), all as
shown outlined on a map marked Section 80-11A0026, which is attached hereto and
made a part hereof, and which is hereby adopted as a part of an amendment to
the zoning maps constituting a part of said chapter and as an amendment to
Section 80-11 thereof.
Section B. That a preliminary plan for the area
legally described above is hereby approved, subject to the following
conditions:
1. That the developer submit a storm drainage
study to the City Engineer's Office for approval and that the
developer make any improvements as required by the City
Engineer's Office.
2. That the developer submit plans for grading and
siltation and erosion control to the City Engineer's Office for
approval prior to beginning any construction activities.
3. That the developer obtain a land disturbance
permit from the Missouri Department of Natural Resources if the
disturbed area for the entire development exceeds five
acres.
4. That the developer remove the existing
temporary signage prior to the approval of a final plan by the City
Plan Commission.
5. That the developer submit a final plan to the
City Plan Commission for approval including plans for landscaping,
prior to the issuance of a building permit.
A copy of said preliminary plan is on file in the office
of the City Clerk under Document No. 970120, which is attached hereto and made
a part hereof.
Section C. That the Council finds and declares that
before taking any action on the proposed amendment hereinabove, all public
notices and hearings required by the Zoning Ordinance have been given and had.
