ORDINANCE NO. 080291
AS AMENDED
Approving the Hillside
Redevelopment Corporation 353 Development Plan for the redevelopment and
rehabilitation of the neighborhood as provided in the Urban Redevelopment
Corporation Law of the State of Missouri (Chapter 353, RSMo) for an area of
approximately 138.32 acres generally located at the northwest quadrant of Hwy
350/Blue Parkway and the area between the eastbound and westbound lanes of Hwy
350/Blue Parkway, just east of Raytown, (the Redevelopment Area), declaring
such redevelopment necessary for the preservation of the public peace,
prosperity, health, safety, morals and welfare; authorizing the City to enter
into a contract with the Hillside Redevelopment Corporation for implementation
of the Development Plan, and authorizing certain tax abatement within the
Redevelopment Area. (Case No. 666-S)
WHEREAS, Hillside
Redevelopment Corporation, an urban redevelopment corporation organized under
and pursuant to the Urban Redevelopment Corporation Law, Chapter 353, RSMo and
amendments thereto and having been incorporated, on December 21, 2007, file
with the City of Kansas City, Missouri, an application for approval of a Development
Plan which contemplated the redevelopment of the Redevelopment Area; and
WHEREAS, the
City Clerk referred said application for a Development Plan to the City Plan
Commission; and
WHEREAS the City Plan
Commission caused to be published in the Daily Record, a newspaper doing the
Citys printing, on February 18, 2008, notice of the public hearing on a
finding of blight for the Redevelopment Area not less than 10 days before the
hearing; and
WHEREAS the City Plan
Commission reviewed and recommended approval of the finding of blight at the
public hearing on March 4, 2008, at which all interested parties were given the
opportunity to be heard; and
WHEREAS the City
Council passed Ordinance 080173 finding the Redevelopment Area to be blighted
on March 6, 2008; and
WHEREAS the City Plan
Commission caused to be published in the Daily Record, a newspaper doing the
Citys printing, on March 11, 2008, notice of the public hearing on said
Development Plan not less than 10 days before the hearing; and
WHEREAS the City
Plan Commission reviewed the proposed Development Plan and recommended approval
of the proposed Development Plan at the public hearing on April 1, 2008, at
which all interested parties were given the opportunity to be heard; NOW,
THEREFORE,
BE IT ORDAINED
BY THE COUNCIL OF KANSAS CITY:
Section A. That the Development
Plan, a copy of which plan is attached hereto as Exhibit A and incorporated
herein by reference, is hereby approved.
Section B. That
approval of the Development Plan and construction of the redevelopment project
are necessary for the preservation of the public peace, prosperity, health,
safety, morals and welfare.
Section C. That
the Director of Finance be authorized and directed on behalf of the City to
enter into a contract with the Hillside Redevelopment Corporation for the
redevelopment of the Redevelopment Area, a copy of which, in substantial form,
is attached hereto and made a part hereof as Exhibit B, provided that the
provisions on Exhibit C, regarding market value, be incorporated into the
contract.
Section D. That
the Hillside Redevelopment Corporation is hereby granted partial tax abatements
on land and improvements in the Redevelopment Area as requested in the
Development Plan and as provided in Exhibit B, subject to the execution of the
contract.
