ORDINANCE NO. 051457

 

Approving an amendment to a previously approved preliminary plan in District CP-3 on a 9.96 acre tract of land generally located east of N. Pennsylvania Avenue and south of N.W. 71st Street along the Kansas City/Gladstone city limits. (8063-CP-8)

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That an amendment to a previously approved preliminary plan in District CP-3 (Regional Planned Business Center) on approximately a 9.96 acre tract of land generally located east of N. Pennsylvania Avenue and south of N.W. 71st Street along the Kansas City/Gladstone city limits, and more specifically described as follows:

 

This is a subdivision of all that part of the Northeast Quarter of Section 22, Township 51, Range 33, being partially in Kansas City, Missouri and partially in the City of Gladstone, Clay County, Missouri, described as follows: Beginning at a point on the east line of the Northeast Quarter of said Section 22, said point being North 0030'19" East, a distance of 961.00 feet from the southeast corner of the Northeast Quarter of said Section 22; thence South 8657'19" West, a distance of 582.00 feet; thence North 0030'19" East along the east line of Lots 25 thru 36, both inclusive, Hamilton Heights West, a subdivision of land in Kansas City and Gladstone, Clay County, Missouri, and the southerly prolongation thereof, a distance of 767.02 feet to the northeast corner of Lot 36 of said Hamilton Heights West; thence South 8929'41" East along the south line of Lots 38 thru 44, both inclusive and the easterly prolongation thereof, a distance of 580.88 feet to a point on the east line of the Northeast Quarter of said Section 22; thence South 0030'19" West a distance of 730.98 feet to the point of beginning.

 

is hereby approved, subject to the following conditions:

 

1. That the developer submit plans for grading and siltation and erosion control to Development Services for approval prior to the commencement of any construction activities.

 

2. That the developer obtain a land disturbance permit from Development Services prior to beginning any construction, grading, clearing or grubbing activities, if the disturbed area exceeds one acre.

 

3. That the developer submit a detailed micro storm drainage study, consisting at a minimum of a letter from a Missouri Licensed Civil Engineer stating that the proposed improvements will not alter or increase historical runoff conditions for the site, to Development Services prior to approval and issuance of any building permits, and that the developer construct any improvements as required by Development Services.

 

4. That the developer provide a cross access easement across the development as required by Development Services prior to issuance of building permits.

 

A copy of said amendment is on file in the office of the City Clerk with this ordinance and is made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
