ORDINANCE NO. 100074
Accepting approximately 11.13
acres of vacant land contiguous to Sunset Park as an expansion to Sunset Park
and declare it to be Park property and to remain such forever in accordance
with the provisions of Section 1004 of the Charter as an addition to the Kansas
City, Missouri, Parks, Recreation and Boulevard System and directing the City
Clerk to record this ordinance and attached documents.
WHEREAS, it has
been the desire of the Board of Parks and Recreation Commissioners to enhance
and expand open space and recreation opportunities by adding additions to the
parks system; and
WHEREAS, Sunset Park,
a 16.85 acre neighborhood park within the River Forest neighborhood north of
the river in Kansas City, Clay County, Missouri, was acquired in 1957 and is
generally located at N.E. Rock Creek Drive and N. Garfield Avenue; and
WHEREAS, an 11.13
acre parcel was purchased from James E. and Carolyn O’Laughlin as an addition
to Sunset Park, bringing the total size of the park to 27.98 acres; NOW,
THEREFORE,
BE IT ORDAINED BY THE
COUNCIL OF KANSAS CITY:
Section 1. That the
Council is requested to accept the deed to the following described land and
declare it to be Park property and to remain such forever in accordance with
the provisions of Section 1004, of the Charter, as an addition to the Kansas
City, Missouri, Parks Recreation and Boulevard System. This tract being more
particularly described as follows:
All that part of the
Southeast 1/4 of Section 12, Township 50, Range 33, including Lots 6 through
18, both inclusive, Block 15, "Farview", a subdivision of land, all
in Kansas City, Clay County, Missouri, described as follows: Beginning at the southwest
corner of the Southeast 1/4 of the Southeast 1/4 of said Section 12, being the Southwest
corner of a tract of land condemned
by the City of Kansas City, Missouri for Park and Recreation purposes and as
described in ordinance of Kansas City, Missouri, No. 21676, passed July 5, 1957; thence North 0 degrees 00 minutes 00
seconds West, along the west line of said 1/4 1/4 section and the west line of
said tract of land, a distance of 130.00
feet; thence North 44 degrees 08 minutes 07 seconds East, continuing along the west
line of said tract of land, a distance of 188.11 feet; thence northerly, continuing along said west line, along
a curve to the right, having an
initial tangent bearing of North 32 degrees 33 minutes 00 seconds West, a
radius of 750.75 feet and a central angle of 40 degrees 45 minutes 03 seconds,
an arc distance of 533.96 feet;
thence North 8 degrees 12 minutes 03 seconds East, continuing along said west line, a distance of
100.00 feet; thence northerly, continuing along said west line, along a curve
to the left, tangent to the last
described course, having a radius of
2518.54 feet, and a central angle of 13 degrees 57 minutes 19 seconds, an arc distance of 613.43 feet; thence northerly,
continuing along said west line, along a curve to the left, tangent to
the last described course, having a radius of 754.23 feet and a central
angle of 41 degrees 40 minutes 40 seconds, an arc distance of 548.64 feet to a
point on the east line of N. Garfield Avenue, as now established; thence South
9 degrees 43 minutes 28 seconds West, along said east line, a distance of 222.44 feet; thence southerly
continuing along said east line, along a curve to the left, tangent to
the last described course, having a radius of 475.00 feet and a central
angle of 17 degrees 37 minutes 11 seconds, an arc distance of 146.07 feet;
thence South 7 degrees 53 minutes 43
seconds East, continuing along said east line, a distance of 191.59 feet; thence southerly, continuing along said east line, along a curve to the right, tangent to
the last described course, having a radius of 525.00 feet and a central angle of 22 degrees 59 minutes 17 seconds, an arc
distance of 210.64 feet; thence South 15
degrees 05 minutes 34 seconds West, continuing along said east line, a distance
of 278.22 feet; thence South 4 degrees 28 minutes 54 seconds West,
continuing along said east line, a distance
of 364.35 feet; thence southerly, continuing along said east line, along a
curve to the left, tangent to the
last described course, having a radius of 275.00 feet and a central angle of 7
degrees 53 minutes 25 seconds, an arc distance of 37.87 feet; thence South 3
degrees 24 minutes 31 seconds East, continuing along said east line, a
distance of 190.13 feet, to the northwest corner of Lot 5, Block 15, said
"Farview"; thence North 86 degrees 35 minutes 29 seconds East, along
the north line of said Lot 5, a distance of 191.73 feet to the northeast corner thereof; thence South 0 degrees 33
minutes 10 seconds East, along the east
line of Lots 5, 4, 3, 2 and 1, Block 15, of said "Farview" and the southerly prolongation thereof, a distance of 356.11 feet (platted 355.52 feet) to a point on
the south line of the Southwest 1/4 of the Southeast 1/4 of said Section
12; thence North 89 degrees 33 minutes 40
seconds East, along the south line of said 1/4 1/4 Section, a distance
of 114.01 feet to the point of beginning.
Section 2. That upon the effective date of
this ordinance, the City Clerk is directed to record it in the Office of the
Clay County Recorder of Deeds in Clay County, Missouri, as evidence of the
acceptance of the land by Kansas City for public use for park purposes and the
Council declares in accordance with the provisions of Resolution No. 28714,
adopted November 24, 2009, by the Board of Parks and Recreation Commissioners,
that the land, in accordance with Section 1004 of the Charter of Kansas City,
shall remain as part of the Parks system forever.
