RESOLUTION NO. 910516

 

Authorizing and requesting the Mayor to submit a grant application under the State Services to Victims Fund to the State of Missouri in the amount of $65,386.00 for a Victim-Assistance Program.

WHEREAS, the State's initial Victim Assistance Program was established by the Missouri General Assembly under the auspices of the Department of Public Safety with the adoption of Section 595.050, R.S.Mo. in 1981. With the passage of Section 595.100, R.S.Mo. (1988), the Services to Victims Fund was established. The Services to Victims Fund consists of money collected pursuant to Section 595.045, R.S.Mo.; and

 

WHEREAS, the Missouri Department of Public Safety administers the funds at the State level solely for the administration of contracts for services to victims of crime pursuant to Section 595.050, 595.055, and 595.105, R.S.Mo.; and

 

WHEREAS, the Crime Victims' Compensation Fund has been established in Missouri State Treasury. A fee of five dollars ($5.00) is assessed as costs in each court proceeding filed in any court in the state for violation of a criminal law of the state, including an infraction and violation of a municipal or county ordinance; and

 

WHEREAS, each year $250,000.00 is allocated to the Crime Laboratories Funds. Seventy-five percent (75%) of the balance goes into the Crime Victims Compensation Fund. The remaining twenty-five percent (25%) goes to the State Services to Victims Fund; and

 

WHEREAS, as of February 28, 1991, $539,000.00 had been collected for the State Services for Victims Fund for Fiscal Year 1992. The Department of Public Safety estimates that there will be $1,000,000.00 in the State Services for Victims Fund for Fiscal Year 1992; and

 

WHEREAS, the City of Kansas City, Missouri is an "eligible applicant" under the rules and regulations; and

 

WHEREAS, there is a sufficient number of citizens of Kansas City, Missouri who are victims of violent crime who could benefit under the provisions of the State Services to Victims Fund; and

 

WHEREAS, in 1990, there was 6,467 arrests for domestic violence assault; it is in the best interest of Kansas City, Missouri and its citizens to apply for a grant from the State of Missouri Department of Public Safety to secure assistance for its less fortunate citizens who have suffered physical or mental injury through acts which are in violation of criminal laws; and

 

WHEREAS, the Victim Assistance Program administered by the Prosecutor Division of the Law Department would provide to victims of domestic violence assaults support, encouragement, explanation of court proceedings, assist prosecutors in case preparation at the Municipal Court level and trial de novo level, notify victims of continued court dates, encourage participation in prosecution and to make appropriate court and social service referrals; NOW, THEREFORE,

 

BE IT RESOLVED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That the Mayor is authorized and requested to submit a grant application with the State of Missouri, Department of Public Safety under the State Services to Victims Fund, to provide monies for a Victim-Assistance Program.

 

Section B. That the Mayor and Council of Kansas City, Missouri authorized the Prosecutor Division of the Law Department of the City to administer the Victim-Assistance Program under the State Services to Victims Fund.
