RESOLUTION NO. 081172

 

Approving an amendment to the Blue Valley Industrial Area Plan by amending the Proposed Land Use Plan and Map on about 23.8 acres generally located on the south side of Winner Road (U. S. Highway 24) on the east side of Smalley Avenue, by changing the recommended land uses from low density residential, retail commercial and light industrial to heavy industrial. (221-S-5)

 

WHEREAS, the City Council, through the adoption of Resolution No. 48603 on January 12, 1978, adopted the Blue Valley Industrial Area Plan being the Plan for development and redevelopment of that area bounded by Kansas City Terminal Railway on the north, Interstate 70 on the south, Independence city limits on the east and Topping Avenue on the west; and

 

WHEREAS, said Blue Valley Industrial Area Plan was amended on April 15, 1993, through the adoption of Resolution No. 930262; and

 

WHEREAS, said Blue Valley Industrial Area Plan was amended on August 27, 1998, through the adoption of Resolution No. 980945; and

 

WHEREAS, after further review by the City Development Department it has been deemed appropriate to amend the Blue Valley Industrial Area Plan as it affects that area generally located on about 23.8 acres generally located on the south side of Winner Road (U. S. Highway 24) on the east side of Smalley Avenue, by changing the recommended land uses from low density residential, retail commercial and light industrial to heavy industrial; and

WHEREAS, public notice of the hearings before the City Plan Commission was published on October 6, 2008; and

 

WHEREAS, the City Plan Commission considered such amendment to the Proposed Land Use Plan and Map on October 21, 2008; and

 

WHEREAS, after all interested persons were given an opportunity to present testimony, the City Plan Commission did on October 21, 2008 recommend approval of the proposed amendment to the Blue Valley Industrial Area Plan; NOW, THEREFORE,

 

BE IT RESOLVED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That the Blue Valley Industrial Area Plan is hereby amended as to the Proposed Land Use Plan and Map for about 23.8 acres generally located on the south side of Winner Road (U. S. Highway 24) on the east side of Smalley Avenue, by changing the recommended land uses from low density residential, retail commercial and light industrial to heavy industrial. A copy of the amendment to the Blue Valley Industrial Area Plan is attached hereto and is incorporated herein by reference.


Section B. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
