RESOLUTION NO. 910195

 

Amending the Country Club Area Plan for that area generally bounded on the north by Volker Boulevard and Ward Parkway, on the west by State Line, on the south by Gregory Boulevard, on the east by Troost Avenue from Gregory Boulevard to 63rd Street and by Oak Street from 63rd Street to Volker Boulevard.

WHEREAS, the Country Club Area Plan was approved by Resolution No. 51866, adopted August 28, 1980, for that area generally bounded on the north by Volker Boulevard and Ward Parkway, on the west by State Line, on the south by Gregory Boulevard, on the east by Troost Avenue from Gregory Boulevard to 63rd Street and by Oak Street from 63rd Street to Volker Boulevard; and

 

WHEREAS, the Country Club Area Plan has been amended by Resolution No. 53516, adopted December 23, 1981 and by Resolution No. 60437, adopted February 13, 1987 and by Committee Substitute for Resolution No. 63220, adopted June 1, 1989; and

 

WHEREAS, the City Development Department has initiated a study to identify certain areas within the Country Side Neighborhood, being that area generally bounded by 55th Street, Westover Road, Brookside Boulevard, 57th Street and Wornall Road for a specific rezoning action; NOW, THEREFORE,

 

BE IT RESOLVED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That the Country Club Area Plan is hereby amended by adding a new Section 11 to Chapter IV, A Number of Actions Are Needed to Improve the Area, Protect the Quality of the Area and Alleviate Certain Problems, of the Plan; said Section 11 to read as follows:

 

11. Areas of the Country Side Neighborhood should be rezoned.

 

The existing zoning in parts of the Country Side

Neighborhood is not consistent with existing lot sizes. It is recommended that the area bounded by 55th Street and Westover Road east of Main, Brookside Boulevard, 57th Street and Wornall Road (excluding the property of St. Teresa Academy and the William Cullen Bryant School) be rezoned from District R-1b to District R-1a. Most of the parcels within this area are developed with lots 7,500 square feet in area and 50 feet in width, which are the requirements of District R-1a.

 


In addition, it is recommended that the three parcels at the west corner of 54th Terrace and Westover Road (5438 and 5448 Westover Road; 25 East 54th Terrace) be rezoned from District R-2a to District R-1b. The parcels are single family and do not conform to the R-2a requirement for duplexes.

 

These changes will bring the zoning into conformance with

the existing conditions and discourage future development that would be incompatible with the existing character of the Country Side Neighborhood.

 

 

Section B. That in all other respects, the Country Club Area Plan, as approved by Resolution No. 51866, adopted August 28, 1980, and as amended by Resolution No. 53516, adopted December 23, 1981 and by Resolution No. 60437, adopted February 13, 1987 and by Committee Substitute for Resolution No. 63220, adopted June 1, 1989, remains in full force and effect.

 

Section C. That the Council finds and declares that before taking any action on the proposed plan, all public notices and hearings required by law have been given and had.
