located on the south side of N.W. Barry Road between N. Marston Avenue and N. Platte Purchase Drive. (SD 0713C)
BE IT ORDAINED
BY THE COUNCIL OF KANSAS CITY:
Section A. That
the preliminary plat of Platte Purchase Plaza on an approximately 21.68 acre
tract of land generally located on the south side of N.W. Barry Road between N.
Marston Avenue and N. Platte Purchase Drive, and more specifically described as
follows:

A tract of land in
the Southeast Quarter of Section 9 and the Fractional Southwest Quarter of
Section 10, both being in Township 51, Range 33, Kansas City, Platte County,
Missouri, being bounded and described as follows: Commencing at the Northwest
corner of said Fractional Southwest Quarter; thence South 00o3244
West, along the West line of said Fractional Southwest Quarter, 36.17 feet to a
point on the Southerly right-of-way line of NW Barry Road, as now established,
said point being the True Point of Beginning of the tract to be herein
described; thence Easterly, along said Southerly right-of-way line, along a
curve to the left, having an initial tangent bearing of North 86o4405
East, a radius of 1,669.87 feet and a central angle of 03o2020, an
arc distance of 97.31 feet (Deed-97.20); thence North 83o2345
East, along said Southerly right-of-way line, 18.16 feet; thence Easterly,
along said Southerly right-of-way line, along a curve to the right, tangent to
the last described course, having a radius of 2,948.00 feet and a central angle

tangent with the last described course, a radius of 3,052.00 feet and a central

South 89o1404 East, along said Southerly right-of-way line, 191.89
feet (Deed-191.66) to a point on the Westerly right-of-way line of N. Platte
Purchase Drive, as now established; thence Southeasterly, along said Westerly
right-of-way line, along a curve to the right, tangent to the last described
course, having a radius of 26.00 feet and a central angle of 89o2343,
an arc distance of 40.57 feet (Deed-40.72); thence South 00o0939
West, along said Westerly right-of-way line, 123.58 feet; thence Southerly,
along said Westerly right-of-way line, along a curve to the right, tangent to
the last described course, having a radius of 1,000.00 feet and a central angle
of 10o4303, an arc distance of 187.06 feet; thence South 10o5242

Southerly, along said Westerly right-of-way line, along a curve to the right,
tangent to the last described course, having a radius of 500.00 feet and a
central angle of 13o4847, an arc distance of 120.54 feet
(Deed-120.55); thence South 24o4129 West, along said Westerly
right-of-way line, 6.93 feet to the Northeast corner of Lot 1, BARRY WOODS
STATION, a subdivision in Kansas City, Platte County, Missouri; thence South 89o0621
West, along the North line of said Lot 1, 639.23 feet (Plat-639.32) to the
Northwest corner of said Lot 1, being also a point on the East line of the
Southeast Quarter of said Section 9; thence South 00o3244 West
(Plat-S00o3249W), along said East line, 179.96 feet to the
Northeast corner of Tract B, BARRY HARBOR SEVENTH PLAT, a subdivision in
Kansas City, Platte County, Missouri; thence North 89o2716 West
(Plat-N89o2655W), along the Northerly line of said Tract B, 439.28
feet; thence Westerly, along said Northerly line, along a curve to the left,
having an initial tangent bearing of North 34o2403 West, a radius
of 245.00 feet, and a central angle of 71o3210, an arc distance of
305.89 feet; thence Westerly, along said Northerly line, along a curve to the
right, having a common tangent with the last described course, a radius of
255.00 feet, and a central angle of 38o3032 , an arc distance of
171.39 feet to a point on the East line of Lot 1, Block 12, said BARRY HARBOR
SEVENTH PLAT; thence North 00o3244 East (Plat-N00o3305E),
along the East line, 114.68 feet to the Northeast corner thereof; thence North
89o1752 West (Plat-N89o1731W), 152.80 feet to the
Northwest corner of said Lot 1, said point being also on the Easterly
right-of-way line of N. Marston Avenue, as now established; thence North 0o4208
East (Plat-N0o4223E), along said Easterly right-of-way line,
425.20 feet (Plat-425.00) to its intersection with the aforementioned
Southerly right-of-way line of NW Barry Road; thence South 89o1710
East, along said Southerly right-of-way line, 1029.24 feet to a point on the
East line of said Southeast Quarter; thence North 0o3244 East,
along said East line, 3.83 feet to the True Point of Beginning.
Containing 924,126 square feet or 21.22 acres, more or less.
is hereby approved, subject to
the following conditions:
1.
That the developer shall cause the area to be platted and processed in
accordance with Chapter 66, Code of Ordinances of the City of Kansas City,
Missouri, commonly known as the Subdivision Regulations.
2.
That the developer submit a macro/micro storm drainage study to the
City Engineer's Office for approval for the entire development when the first
plat is submitted, and that the developer construct any improvements as
required by the City Engineer's Office.
3. That
the developer provide a storm water conveyance system to serve all proposed
lots within the development and determine adequacy as required by the
Department Public Works.
4.
That the developer submit plans for grading, siltation, and erosion
control to the City Engineer's Office for approval and permitting prior to
beginning any construction activities.
5. That
the developer secure a site disturbance permit from the Department of Public
Works prior to beginning any construction, grading, clearing, or grubbing
activities, if the disturbed area exceeds one acre.
6.
That the developer install hard surface roads and provide for fire
protection as required by the Fire Department prior to construction beyond
foundations.
7.
That the developer extend water mains as required by the Water Services
Department.
8. That
the developer extend sanitary sewers to ensure individual service is provided
to all proposed lots and determine adequacy as required by the Department of
Public Works.
9. That
the developer make improvements required by the traffic study as required by
the Department of Public Works, with specific improvements identified prior to
the ordinance request.
10. That
the developer obtain the grading consents, and all grading, temporary
construction and drainage/sewer easements from the abutting property owner
prior to submitting any public improvements.
11. That
the developer secure permits to construct or reconstruct existing sidewalks,
curb, gutter, storm sewers, and streetlights as necessary along all development
street frontages, as required by the Department of Public Works, prior to
recording the plat.
12. That
the developer provide a cross access easement for the development on the final
plat.
13. That
the developer submit covenants, conditions and restrictions to the Law
Department for approval for the maintenance of private open space and enter
into a covenant agreement for the maintenance of any stormwater detention area
tracts.
14. That
the developer lower or otherwise modify the existing storm drainage inlet
located on the southern portion of Lot G to insure that any storm water
properly discharges within 48 hours after a rainfall event.
A copy of the preliminary plat is
on file in the office of the City Clerk under Document No. 050023, which is
attached hereto and made a part hereof.
Section B. That
the Council finds and declares that before taking any action on the proposed
preliminary plat hereinabove, all public notices have been given and hearings
have been held as required by the Subdivision Regulations.
