Approving an amendment to a
previously approved preliminary plan in District R-5-p on a 27 acre tract of
land generally located on the east side of Raytown Road, about 700 feet north
of 53rd Street. (7050-P-12)
BE IT ORDAINED BY THE
COUNCIL OF KANSAS CITY:
Section A. That an
amendment to a previously approved preliminary plan in District R-5-p (High
Apartments, Limited District) on a 27 acre tract of land generally located on
the east side of Raytown Road, about 700 feet north of 53rd Street, and more
specifically described as follows:
Lots 1, 2, and 3, Park
Lane Acres, and Lot 1, Two Rivers Acres.
TRACT 1: Lots 1, 2
and 3, except the part of said Lot 1 platted as ("Two Rivers Acres",
in the plat recorded July 21, 1987, in Plat Book I-44, at page 13, as Document No.
I-787455) Park Lane Acres, a subdivision in Kansas City, Jackson County, Missouri,
according to the plat thereof recorded September 17, 1976, in Plat Book I-35,
at page 6, as Document No. I-258153.
TRACT 2: Two Rivers
Psychiatric Hospital that part of Tract 1, Lot 1, Park Lane Acres, a
subdivision in Kansas City, Jackson County, Missouri, replatted as Two Rivers Acres
according to the plat recorded July 21, 1987, in Plat Book I-44, at page 13, as
Document No. I-787455, described as follows: Beginning at the northeast corner
of Lot 1, Park Lane Acres, subdivision of land in Kansas City, Missouri, said
point being on the west line of the right-of-way of the Rock Island Railroad
(50 feet from the centerline thereof), thence along said west right-of-way line
parallel to said centerline in a southerly direction along a curve to the right
(having a radius of 2192.0 feet) 402.77 feet to the southeast corner of said Lot
1, thence along the south line of said Lo, North 87 degrees 00 minutes 59
seconds West, 785 feet, thence North 25 degrees 06 minutes 03 seconds West,
102.08 feet, thence North 2 degrees 58 minutes 11 seconds East, 310 feet to a
point on the north line of said Lot 1; thence along said north line South 86
degrees 53 minutes 49 seconds East, 780 feet to the point of beginning,
containing 322,290 square feet or 7.398 acres.
is hereby approved, subject to
the following conditions:
1. That the developer submit an update to the previously
accepted micro storm drainage study to address the development amendments along
with a BMP level of service analysis for review and acceptance prior to
approval and issuance of any building permits and make necessary improvements
as required by Development Services prior to issuance of any certificate of
occupancy.
2. That the developer submit a letter from a licensed civil
engineer, licensed architect, or licensed landscape architect, who is registered
in the State of Missouri, stating the condition of the sidewalks, curbs, and
gutters. The letter must identify state of repair as defined in Chapters 56
and 64, Code of Ordinances, for the sidewalks, curbs, and gutters. It shall
identify the quantity and location of sidewalks, curbs, and gutters that need
to be constructed, repaired, or reconstructed. The developer shall secure
permits to repair or reconstruct the identified sidewalks, curbs, and gutters
as necessary along all development street frontages, as required by Development
Services, prior to issuance of any certificate of occupancy.
3. That the developer submit plans for grading, siltation, and
erosion control to Development Services for review, acceptance, and permitting
prior to beginning any construction activities.
4. That the developer secure a site disturbance permit from
Development Services prior to beginning any construction, grading, clearing, or
grubbing activities, if the disturbed area equals one acre or more.
5. That the developer grant a BMP Easement to the City, as
required by Development Services, prior to issuance of any certificate of
occupancy.
6. That the developer submit a final plan to the City Plan
Commission for approval, including detailed information on landscaping,
lighting (including a photometric study showing zero footcandles at the
property line and no direct illumination beyond the property line) and building
elevations.
A copy of said amendment is on
file in the office of the City Clerk with this ordinance and is made a part
hereof.
Section B. That the
Council finds and declares that before taking any action on the proposed
amendment hereinabove, all public notices and hearings required by the Zoning
Ordinance have been given and had.
