ORDINANCE NO. 010824

 

Amending Chapter 80, Code of Ordinances, by adding a new section to be known as Section 80-11A0372, rezoning an area of approximately 0.987 acres generally located at the northeast corner of 87th Street and Blue Ridge Boulevard from District C-2 (Local Retail Business) to District PD/C-2 (Planned District/Local Retail Business), and approving a development plan for the same. BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Chapter 80, Code of Ordinances of the City of Kansas City, Missouri, 1996, commonly known as the Zoning Ordinance, is hereby amended by enacting a new section to be known as Section 80-11A0372, rezoning an area of approximately 0.987 acres generally located at the northeast corner of 87th Street and Blue Ridge Boulevard from District C-2 (Local Retail Business) to District PD/C-2 (Planned District/Local Retail Business), said section to read as follows:

 

Section 80-11A0372. That an area legally described as:

 

All that part of the Southwest One-Quarter of the Northwest One-Quarter of Section 19, Township 48, Range 32, being partially in Raytown and partially in Kansas City, and wholly in Jackson County, Missouri, described as follows: Commencing at the intersection of the southeasterly right of way line of Blue Ridge Boulevard Extension, as established by Document No. 290604 in Book 567 at page 111 and Document No. 303581 in Book 572 at page 180, and the east line of said Quarter Quarter Section; thence South 46E28'00" West along said southeasterly right of way line, a distance of 190.28 feet; thence continuing along said right of way line in a southwesterly direction along a curve to the left tangent to the last described course and with a radius of 1095.92 feet, an arc distance of 114.28 feet to the true point of beginning of the tract of land to be herein described; thence continuing along last said curve, having a central angle of 16E58'37", an arc distance of 324.73 feet to an angle point therein; thence South 44E59'48" East along said right of way line, as established by Document No. 594937 in Book 973 at page 256, a distance of 11.72 feet to a point on the north right of way line of 87th Street, as established by Document No. A-427845 in Book B-2940 at page 411; thence North 89E36'00" East, along the north right of way line of 87th Street, a distance of 216.14 feet to a point on the west line of a tract of land described in Document No. I-1084484 in Book I-2203 at page 1577; thence North 0E09'00" West, along said west line, a distance of 115.00 feet to an angle point therein; thence North 27E02'59" West, continuing along said west line, a distance of 84.12 feet to the northwest corner thereof; thence North 44E52'57" West, a distance of 128.62 feet to the point of beginning. Containing 42,992 square feet or 0.987 acres, more or less.

 


is hereby rezoned from District C-2 (Local Retail Business) to District PD/C-2 (Planned District/Local Retail Business), all as shown outlined on a map marked Section 80-11A0372, which is attached hereto and made a part hereof, and which is hereby adopted as a part of an amendment to the zoning maps constituting a part of said chapter and as an amendment to Section 80-11 thereof.

 

Section B. That a development plan for the area legally described above is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, as amended, commonly known as the Subdivision Regulations.

 

2. That the developer submit a storm drainage study for the entire development to the City Engineers Office for approval when the final plat is submitted and that the developer make any necessary improvements as required by the City Engineers Office.

 

3. That the developer submit plans for grading and siltation and erosion control to the City Engineers Office for approval prior to the commencement of any construction activities.

 

4. That the developer improve the north side of 87th Street to primary arterial street standards as required by the Department of Public Works, including construction of sidewalks, curbs and gutter and installation of streetlights.

 

5. That the developer improve the east side of Blue Ridge Boulevard to primary arterial street standards as required by the Department of Public Works, including construction of sidewalks, curbs and gutter and installation of streetlights.

 

6. That the developer install hard surface roads and provide for fire protection as required by the Fire Department prior to construction beyond foundations.

 

7. That the developer extend water mains as required by the Water Services Department.

 

8. That the developer extend sanitary sewers as required by the Department of Public Works.

 

9. That the developer receive the approval of the City of Raytown for access onto 87th Street prior to issuance of a building permit as required by the Department of Public Works.

 

10. That the developer submit a final plan to the City Plan Commission for approval, including plans for landscaping, grading, signage and building elevations.

A copy of said development plan is on file in the office of the City Clerk under Document No. 010824, which is attached hereto and made a part hereof.

 

Section C. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
