ORDINANCE NO. 001174

Approving the plat of North Hampton Seventh, an addition in Kansas City, Clay County, Missouri; accepting and releasing various easements; establishing grades on public ways; accepting certain lands for park purposes forever, in accordance with Section 58 of Article III of the Charter of Kansas City.

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

Section 1. That the plat of North Hampton Seventh, a subdivision in Kansas City, Clay County, Missouri, a true and correct copy of which is attached hereto and incorporated herein by reference is hereby approved.

Section 2. That the plat granting and reserving unto Kansas City an easement and license or right to locate, construct, operate and maintain facilities including, but not limited to, water, gas, sewerage, telephone, cable TV, surface drainage, underground conduits, pad mounted transformers, service pedestals, any and all of them upon, over, under and along the strips of land outlined and designated on the plat by the words utility easement or U/E be and the same are hereby accepted and where other easements are outlined and designated on the plat for a particular purpose, be and the same are hereby accepted for the purpose as therein set out.

Section 3. That the grades of the streets and other public ways set out on the plat, herein accepted, are hereby established at the top of curb, locating and defining the grade points which shall be connected by true planes or vertical curves between such adjacent grade points, the elevations of which are therein given, in feet above the City Directrix.

Section 4. That all right, title and interest in a sewer easement accepted by Kansas City, under Document No. N19500, recorded October 29, 1996, be and the same is hereby released to the respective owner, their successors or assigns.

Section 5. That the lands heretofore designated and selected by the Board of Park and Recreation Commissioners as evidenced by their Resolution No. 25190, duly adopted on August 22, 2000, for public use for park purposes, to-wit:

All that part of the Southeast Quarter of Section 22, Township 52, Range 32, in Kansas City, Clay County, Missouri described as follows: Beginning at the northeast corner of Lot 193, North Hampton Third Plat, a subdivision in said city and state; thence North 90E00'00" East, II 37.25 feet to a point on the east line of said Southeast Quarter- Section; thence South 00E07'37" West, along said east line, 77.99 feet; thence North 89E52'23" West, 70.88 feet; thence South 65E54'00" West, II 9.38 feet; thence South 32E48'01" West, 91.15 feet; thence South 8E59'28" West, 331.23 feet; thence South 0E07'37" West, 124.91 feet; thence South 2El1'32" West, 94.00 feet; thence South 13E44'50" West, 132.34 feet to a point on a curve having a radius of 175.00 feet; thence northwesterly along said curve to the right, with an initial tangent bearing of North 64E36'03" West, an are distance of 71.21 feet to a point of tangency;

thence North 41E17'14" West, 110.74 feet to a point of curvature; thence along said curve to the left, with a radius of 250.00 feet, an arc distance of 92.52 feet; thence North 27E30'36" East, 120.00 feet; thence North 68E38'27" West, 79.29 feet; thence North 77E07'33" West, 68.05 feet; thence North 37E44'33" East, 111.33 feet; thence North 23E02'47' East, 96.21 feet; thence North 13E00'39" West, 126.41 feet; thence North 54E07'24" West, 126.41 feet; thence South 84E45'51" West, 126.41 feet; thence South 44E33'39' West, 121.04 feet; thence South 2E40'59" West, 78.50 feet; thence South 20E05'17" West, 139.26 feet; thence South 7E41'38" West, 139.26 feet; thence South 9E23'54" West, 115.32 feet to a point on the North line of North Hampton Sixth Plat, a subdivision of land in said city and state; thence North 87E01'55" West, along said north line, 134.40 feet; thence North 76E03'40" West, along said north line, 56.07 feet; thence North 7E51'11" East, 258.86 feet; thence North 3E50'49" East, 191.58 feet; thence South 88E51'58" West, 125.78 feet to a point on a curve having a radius of 1525.00 feet; thence northerly along said curve to the left, with an initial tangent bearing of North 10E08'02" West, an are distance of 37.52 feet to a point of tangency; thence North 2E32'36" West, 48.01 feet to a point of curvature; thence along said curve to the left, with a radius of 175.00 feet, an arc distance of 77.80 feet to a point on the platted boundary of said North Hampton Third Plat; thence continuing along said curve, an arc distance of 31.73 feet to the most southerly corner of said Lot 193; thence North 51E35'37" East along the southeast line of said Lot 193, 125.00 feet to the point of beginning.

Containing 11.14 acres, more or less be and the same is hereby accepted for public use for park purposes and shall remain such forever in accordance with Section 58 of Article III of the Charter of Kansas City.

Section 6. That the Council finds that the City Plan Commission has duly endorsed its approval of this Ordinance hereon.
