ORDINANCE NO. 060822

 

Rezoning an area of approximately 1.7 acres generally located at the northeast and southeast corners of 20th Street and Wyandotte Street from District M-1 to District URD and approving a preliminary development plan. (Case No. 13564-URD)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Chapter 80, Code of Ordinances of the City of Kansas City, Missouri, commonly known as the Zoning Ordinance, is hereby amended by enacting a new section to be known as Section 80-11A0693, rezoning an area of approximately 1.7 acres generally located at the northeast and southeast corners of 20th Street and Wyandotte Street from District M-1 (Light Industry) to District URD (Urban Redevelopment District), said section to read as follows:

 

Section 80-11A0693. That an area legally described as:

 

All that part of Lots 15, 16, 21, 22, 23 and 25, Block 13, and all that part of Lots 1, 2, and 3, Block 20, and all Block 27, GOODRICH ADDITION, a subdivision of land, and that part of Vacated St. Paul Avenue lying adjacent thereto, and all that part of the SW 1/4 of the NW 1/4 of Section 8, Township 49, Range 33, all being in Kansas City, Jackson County, Missouri, more particularly described as follows:

 

Beginning at the Northwest corner of said Lot 16, said point also being on the East right-of-way line of Wyandotte Street and the Southeasterly right-of-way line of Southwest Boulevard, as said streets are now established; thence Northeasterly, along the Northwesterly line of said Lots 16 and 15, and along the Southeasterly right-of-way line of said Southwest Boulevard, a distance of 32.85 feet, to a point 2 feet Southwesterly of the Northeasterly line of said Lot 15; thence Southeasterly, along a line 2 feet Southwesterly of and parallel with the Northeasterly line of said Lot 15, and its Southeasterly extension, a distance of 114 feet, to a point on the Northwesterly line of said Lot 25; thence Northeasterly, along the Northwesterly line of said Lot 25, a distance of 81.06 feet, to a point on the centerline of vacated St. Paul Avenue; thence Southerly, along the centerline of said vacated St. Paul Avenue, a distance of 15.42 feet, to a point on the Westerly extension of the North line of said Lot 21; thence Easterly, along the North line and its extension of said Lot 21, a distance of 120 feet, to a point on the West right-of-way line of Baltimore Avenue, as now established; thence Southerly, along the West right-of-way line of said Baltimore, a distance of 50 feet, to a point on the North line of the South 24.5 feet of said Lot 23, said point also being on the North right-of-way line of 20th Street, as now established; thence Westerly, along the North line of the South 24.5 feet of said Lot 23, and along the North right-of-way line of said 20th Street, a distance of 120.61 feet, to a point on the centerline of said vacated St. Paul Avenue; thence Southerly, along the centerline of said vacated St. Paul Avenue, a distance of 79.50 feet, to a point on the North line of the SW 1/4 of the NW 1/4 of said Section 8, and 316.25 feet West of the Northeast corner thereof, said point also being the Northeast corner of McGee Cemetery, as shown on said plat of GOODRICH ADDITION; thence continuing Southerly, along the East line of said McGee Cemetery and its extension along the centerline of St. Paul Avenue, as now established, a distance of 287.20 feet, to a point on the Easterly extension of the South line of said Lot 3; thence Westerly, along the South line and its extension of said Lot 3, a distance of 160.50 feet, to the Southwest corner thereof, said point also being on the East right-of-way line of said Wyandotte Street; thence Northerly, along the West line of said Lots 3, 2, 1, and along the West line of said Block 27 and its extension, and along the West line of said Lot 16, and along the East right-of-way line of said Wyandotte Street, a distance of 440 feet, to the point of beginning, except that part thereof dedicated for street purposes.

 

is hereby rezoned from District M-1 (Light Industry) to District URD (Urban Redevelopment District), all as shown outlined on a map marked Section 80-11A0693, which is attached hereto and made a part hereof, and which is hereby adopted as a part of an amendment to the zoning maps constituting a part of said chapter and as an amendment to Section 80-11 thereof.

 

Section B. That a development plan for the area legally described above is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, commonly known as the Subdivision Regulations.

 

2. That the developer submit a detailed Micro storm drainage study, consisting at a minimum of a letter from a Missouri Licensed Civil Engineer stating that the proposed improvements will not alter or increase historical runoff conditions for the site, to Development Services prior to approval and issuance of any building permits, and that the developer construct any improvements as required by Development Services.

 

3. That the developer secure permits to construct or reconstruct existing sidewalks, alleys, curb, gutter, and streetlights as necessary along 20th Street and St. Paul Avenue, or submit a letter from a Missouri Licensed Civil Engineer stating that the sidewalks, curb and gutter are in a good state of repair and meet the requirements set forth in Chapters 56 and 64, Code of Ordinances, as required by Development Services, prior to recording the plat.

 

4. That the developer enter into an 24 month (from date of plan approval by ordinance) unsecured deferral agreement for the repair of sidewalks, curbs, gutters and sidewalk along Wyandotte Street as required by Development Services in accordance with Chapters 56 and 64, Code of Ordinances, prior to recording of the plat.

 

5. That the developer submit plans for grading and siltation and erosion control to Development Services for approval prior to the commencement of any construction activities.

 

6. That the developer submit a street tree planting plan prior to or concurrent with the final plat submittal, secure the approval of the City Forester for street trees planted on right-of-way (with a copy to be submitted to the City Development Department staff), and agree to plant in conformance with the plan approved by the City Forester. The plan shall include size, type, species, and placement of trees.

7. That the developer contribute $14,225.18 in lieu of parkland dedication for 119 multifamily units (119 units X 2.0 X .006 X $9,961.61 (year 2006) = $14,225.18) in satisfaction of Section 66-128 of the Subdivision Regulations.

 

8. That the minimum required right-of-way width for St. Paul Avenue be waived so as to permit the right-of-way as shown on the development plan.

 

9. That the developer grant a Noise and Aviation Easement to the City as required by Development Services, if applicable.

 

10. That the developer receive any necessary approval of the Board of Zoning Adjustment for maneuvering in public right of way.

 

11. That the developer submit covenants, conditions and restrictions to the Law Department for approval for the maintenance of common elements and private open space tracts.

 

12. That the final plat show and describe all wall dimensions, as well as all floor and ceiling elevations, for each of the condominium units.

13. That the developer submit a final plan to the Director of City Development for approval, including detailed information on landscaping, signage (including elevations), lighting (including a photometric study showing zero footcandles at the property line and no direct illumination beyond the property line per staff approval) and building elevations

 

A copy of said development plan is on file in the office of the City Clerk with this ordinance and is made a part hereof.

 

Section C. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
