ORDINANCE NO. 081031

 

Releasing and abating sanitary sewer special tax assessments of the City upon 34 properties in Sewer District No. 22079, in the vicinity of N.E. 80th Street and N. Antioch Road, due to a clerical error.

WHEREAS, the Council authorized the construction of a special assessment sewer in Ordinance No. 050804 and the collection of special assessments in Ordinance No. 070384; and

WHEREAS, the property owner constructed a sanitary sewer to serve the future subdivision at his expense and connected to a City sewer outside the sewer district prior to construction of the special assessment sewer; and

WHEREAS, due to a clerical error, the sewer district boundaries were not adjusted to reflect this change; and

WHEREAS, the property in question did not benefit from the subsequent construction of the special assessment sewer; and

 WHEREAS, the City Council believes it would be in the best interests of the neighborhood and for the City to release and abate collection of the said portion of the special assessment tax bill on the Collection Sewer serving Sewer District No. 22079 due to a clerical error; NOW, THEREFORE,

  BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

  Section 1. That the Council hereby determines that a public benefit would be gained by the discharge of Special Assessment IDs 49092 through 49125, (Assessment Type PWSA) in the total original principal amount of $34,680.68 and issued by the City pursuant to Ordinance No. 070834 on August 16, 2007 upon the following properties within Sewer District No. 22079:

1. Property at 4009 N.E. 83rd Street, KIVA No. 212571, and legally described as: Lot 59 in Rosemont, a subdivision in Kansas City, Clay County, Missouri

2. 4015 N.E. 82nd Street, KIVA No. 218021, and legally described as: Lot 28, Rosemont Third Plat, a subdivision in Kansas City, Clay County, Missouri

3. 8118 N. Norton Avenue, KIVA No. 218022, and legally described as: Lot 29, Rosemont Third Plat, a subdivision in Kansas City, Clay County, Missouri


4. 8114 N. Norton Avenue, KIVA No. 218023, and legally described as: Lot 30, Rosemont Third Plat, a subdivision in Kansas City, Clay County, Missouri

Section 2. That the Council, pursuant to the authority of Section 818 of the City Charter to release a tax burden as otherwise provided by law does hereby release, abate and discharge said special assessment tax bill, including all accrued interest, penalties and costs thereon.
