RESOLUTION NO. 100549

 

Authorizing the City Manager to enter into negotiations with the Community Baseball Academy of Kansas City to assume ownership of old Fire Station No. 35 at 5005 Swope Parkway for the purpose of developing a year-round, indoor baseball facility for inner-city youths.

 

WHEREAS, in Ordinance No. 090869, the Council declared the City-owned parcel of real property located at 5005 Swope Parkway as surplus to the City’s needs and authorized the sale of this parcel; and

 

WHEREAS, this parcel was duly advertised for sale and no offers for purchase were received; and

 

WHEREAS, the Community Baseball Academy of Kansas City (“CBAKC”) is a 501 (c) (3), not-for-profit organization, which desires to provide a facility that uses baseball to teach life skills that will benefit youth in every facet of their lives; and

 

WHEREAS, the CBAKC’s goal is to develop in boys and girls, ages 5 through 18, the academic and athletic skills necessary to be considered for and awarded baseball and educational scholarships to colleges and universities. CBAKC is being developed by persons involved in both Kansas City and coaching at all levels of baseball which will provide positive influence and adult role models in a child’s life. In order to accomplish their academic goals, they have recruited highly qualified volunteer teachers, bank executives and other academic institutions such as Kansas State University to ensure that CBAKC participants maintain a 3.0 GPA or higher. The goal is to use baseball as a tool to inspire, enlighten and motivate children to greater academic achievements; NOW, THEREFORE,

 

BE IT RESOLVED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the Council recognizes the importance of the public benefit derived from the goals of CBAKC.

 

Section 2. That the Council authorizes the City Manager to enter into negotiations with CBACKC of an agreement that would provide for the conveyance of the old Fire Station No. 35 at 5005 Swope Parkway to CBACKC, contingent upon CBACKC showing to the reasonable satisfaction of the City within six (6) months of the execution of such an agreement that it has available sufficient funding to renovate the structure located on 5005 Swope Parkway to the reasonable satisfaction of the City within a reasonable time for the sole principal use as a community baseball academy or substantially similar use.

 

Section 3. That the Council authorizes the City Manager to enter into negotiations for the conveyance of 5005 Swope Parkway to other non-profit or charitable organizations if CBACKC fails to acquire the necessary funds in the six (6) months described above.
