ORDINANCE NO. 180574

 

Approving and authorizing the discharge of the special tax bills and waiver of the resulting liens on the real property commonly known as 1826 Forest Avenue.

 

WHEREAS, the City issued special assessment tax bills for the cost of five (5) board up abatements at 1826 Forest Avenue, Kansas City, Missouri (the “Property”) pursuant to Section 48-66, one (1) trash and weed abatement at the Property pursuant to Section 48-66 and one (1) re-inspection of the Property pursuant to Section 48-84; and

 

WHEREAS, the total cost of the aforementioned special tax bills, including the costs of tax collection, accrued interest and attorneys’ fees, is $14,096.03; and

 

WHEREAS, Section 48-83(1) authorizes the City Manager to “discharge all or any portion of the special tax bills for an amount exceeding $5,000.00, including the costs of tax collection, accrued interest and attorneys’ fees, only after the Council has authorized such action by ordinance”; and

 

WHEREAS, Section 48-83(3) permits “the discharge of all or any portion of the special tax bills and the waiver of the resulting lien…only upon a determination that a public benefit will be gained by doing so”; and

 

WHEREAS, Section 48-83(4) instructs that “each request for the discharge of all or any portion of the special tax bills against real property and the waiver of the resulting lien shall first be reviewed by the lien waiver review committee, that has been appointed pursuant to Chapter 56, in accordance with the procedures and standards established by the City Manager and its written recommendation will be reported to the City Manager or the Council”; and

 

WHEREAS, the lien waiver review committee met on July 17, 2018, in accordance with the procedures and standards established by the City Manager and found that a public benefit will be gained by the discharge and waiver of the resulting liens against the Property; and

 

WHEREAS, the lien waiver review committee entered into a contract (the “Contract”) with the owner of the Property which provides conditions for the discharge of the special tax bills and waiver of the resulting lien on the real property and is attached hereto as “Attachment A”; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 


Section 1. That the discharge of the special tax bills, including the costs of tax collection, accrued interest and attorneys’ fees of $14,096.03 and waiver of the resulting liens on the Property, subject to the terms of the Contract, is hereby approved.
