ORDINANCE NO. 941570
Authorizing the City Manager and/or the Director of the
Office of Environmental Management and Waste Minimization to enter into an
agreement with PACCAR, Inc., for the purchase of property located at 4701
Deramus and 1301 Chouteau Trafficway for use as a facility for the Solid Waste
Division of the Public Works Department, a maintenance facility for the Parks
and Recreation Department, and for reclamation and recycling operations for the
Office of Environmental Management and Waste Minimization; authorizing the
expenditure of $3,900,000.00 in previously appropriated funds therefor;
directing the City Clerk to record the deed; and recognizing an emergency.
BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:
Section 1. That the City Manager and/or the
Director of the Office of Environmental Management and Waste Minimization are
hereby authorized to enter into an agreement with PACCAR, Inc., a Delaware
corporation, for the purchase from PACCAR, Inc., of the property and
improvements thereon located at 4701 Deramus and 1301 Chouteau Trafficway and
more specifically described in the agreement attached hereto, for use as a
facility for the Solid Waste Division of the Public Works Department, a maintenance
facility for the Parks and Recreation Department, and for reclamation and
recycling operations for the Office of Environmental Management and Waste
Minimization, and to expend $3,900,000.00 in previously appropriated funds
therefor. The agreement shall conform substantially to the copy which is
attached hereto and made a part hereof by reference.
Section 2. That the City Clerk is hereby directed
upon receipt of the deed for the herein described property, to record that deed
in the Office of the Director of Records for Jackson County, Missouri, at
Kansas City as evidence of the acceptance by the City of this property for
public use purposes.
Section 3. That this ordinance, making provisions
for current expenses of the City government, is hereby recognized as an
emergency measure within the provisions of Article II, Section 15 of the
Charter of the City of Kansas City, Missouri, and shall take effect immediately
upon passage.

I hereby certify that there is a balance, otherwise
unencumbered, to the credit of the appropriation to which the foregoing
expenditure is to be charged, and a cash balance, otherwise unencumbered, in
the treasury, to the credit of the fund from which payment is to be made, each
sufficient to meet the obligation hereby incurred.
