ORDINANCE NO. 150572

 

Authorizing the City Manager to execute a Public Parking License Agreement with Corrigan Station, LLC, for the purpose of promoting economic development through the provision of public parking along the City’s streetcar line.

 

WHEREAS, Corrigan Station, LLC (“Corrigan”), is the owner of certain real properties located in Kansas City, Missouri, generally located between Main and Walnut on the north side of 19th Street; and

 

WHEREAS, Corrigan is proposing to redevelop the Corrigan Building, located at 1828 Walnut Street and two adjacent parking lots to construct a structured parking garage containing an anticipated 359 parking spaces located on the east side of Walnut Street across from the Corrigan Building; and

 

WHEREAS, Corrigan will finance, develop, own and operate, and maintain the parking lots and garage; and

 

WHEREAS, the garage will be adjacent to a streetcar station on Main Street, north of 19th Street, and is within the City’s designated streetcar corridor; and

 

WHEREAS, Corrigan has agreed to provide access to discounted public parking for park and ride users, tourists, residents, and the general public weekend and evening hours; and

 

WHEREAS, the additional parking will promote economic development in the City, encourage transit use, attract new jobs to the City and promote the construction of retail services for the citizens of Kansas City; and

 

WHEREAS, Corrigan and the City desire to enter into a license agreement for the purpose of providing for such public parking; and

 

WHEREAS, Corrigan will provide the public parking rights for a term of twenty-five (25) years, commencing upon issuance of a Certificate of Occupancy, provided that the City shall have elected, on an annual basis, to appropriate and pay to Corrigan a license fee of $250,000.00, increasing by five percent (5%) every fifth year for the duration of the license; and

 

WHEREAS, the long-term availability of public parking along the streetcar line is in the public interest such that the City Council deems it advisable to authorize an agreement in excess of five years; NOW, THEREFORE,

 

  BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

 

Section 1. That the City Manager is authorized to execute a Public Parking License Agreement for the purposes set forth herein. The Public Parking License Agreement is approved, in substantial form, as attached to this ordinance.

 

Section 2. That the term of the Public Parking License Agreement is hereby authorized to extend beyond five (5) years as provided in Section 3-43, Code of Ordinances.
