ORDINANCE NO. 100636

 

Approving the preliminary plat of Blue Ridge Crossing Detention on a 3.52 acre tract of land in District R-2a generally located at the southwest corner of E. 43rd Street and Sterling Avenue. (SD 1196C)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That the preliminary plat of Blue Ridge Crossing Detention on a 3.52 acre tract of land in District R-2a (Two-Family Dwellings – Low Density) generally located at the southwest corner of E. 43rd Street and Sterling Avenue, and more specifically described as follows:

 

All of the North 200 feet of Lot 1, and the East 1/2 of vacated Appleton Avenue lying West of and adjacent to said North 200 feet of Lot 1, Annett Acres, a subdivision of land in Kansas City, Jackson County, Missouri, according to the recorded plat thereof, lying in the Northeast Quarter of Section 28 Township 49 North, Range 32 West of the 5th Principal Meridian, being bounded and described as follows: Commencing at the Northeast corner of the Northwest Quarter of the Northeast Quarter of said Section 28; thence North 86 degrees 38 minutes 23 seconds West, along the North line of said Northeast Quarter, 50.01 feet; thence South 02 degrees 00 minutes 03 seconds West, 25.01 feet to the intersection of the West right-of-way line of Sterling Avenue, as now established and the South right-of-way line of 43rd Street, as now established, said point also being the point of beginning of the tract of land to be herein described; thence continuing South 02 degrees 00 minutes 03 seconds West along said West right-of-way line, 100.00 feet; thence South 01 degrees 15 minutes 55 seconds East, continuing along said West right-of-way line, 100.30 feet to a point on the South line of the North 200 feet of said Lot 1; thence North 86 degrees 38 minutes 23 seconds West, along said South line and its Westerly prolongation, 772.21 feet to a point on the centerline of vacated Appleton Avenue as vacated by ordinance in Book 868 at Page 1229 and recorded in the Office of the Recorder of Deeds, said Jackson County, Missouri; thence North 02 degrees 00 minutes 03 seconds East, along said centerline, 200.00 feet to a point on said South right-of-way line; thence South 86 degrees 38 minutes 23 seconds East, along said South right-of-way line, 766.50 feet to the Point of Beginning. Containing 153,542 square feet or 3.52 acres, more or less.

 

is hereby approved, subject to the following conditions:

 

1.                  That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, commonly known as the Subdivision Regulations and this plat shall be recorded prior to or simultaneously with the final plat on the north side of E. 43rd Street (SD 1196A).


2.                  That the developer modify the west leg of and the traffic signals at the intersection of 43rd Street and Sterling Avenue so as to provide a fourteen feet wide westbound receiving lane, a twelve feet wide eastbound left-turn lane, and a twelve foot eastbound through/right-turn lane, said widths being measured exclusive of curb and gutter, as required by Development Services.

 

3.                  That the developer submit an overall street alignment that establishes the centerline of E. 43rd Street to be approved by both Development Services and the Public Works Department prior to ordinance request.

 

4.                  That the developer modify the traffic signals at the intersection of 43rd Street and Sterling Avenue so as to accommodate the proposed geometric modifications to the intersection and add pedestrian facilities and crosswalk across the west, north, and south legs of the intersection, as required by Public Works. Said modifications shall be compliant with the City's traffic signal standards and ADA standards.

 

5.                  That the developer submit new or update the previously accepted macro storm drainage study for the overall development to address the development amendments along with a detailed micro study in general compliance with adopted standards, including a BMP level of service analysis, prior to clearance of the final plat and that the developer secure permits to construct any improvements as required by Development Services prior to recording the plat.

 

6.                  That the developer dedicate additional right of way for collector street with turn lanes as required by Development Services so as to provide a minimum of 34 feet of right of way as measured from the centerline of E. 43rd Street.

 

7.                  That the developer improve the southern one-half of E. 43rd Street to collector street standards as required by Development Services, including curbs, gutters, sidewalks, streetlights, existing roadway section transitions to meet vertical and horizontal alignment standards, and relocation of utilities.

 

8.                  That the developer obtain the grading consents, and all grading, temporary construction and drainage/sewer easements from the abutting property owner prior to submiting any public improvements.

 

9.                  That the developer subordinate to the City all private interest in the area of any right-of-way dedication, as required by Development Services, and that the developer be responsible for all costs associated with subordination activities now and in the future.

 

10.              That after the City Plan Commission enters its disposition for the development plan, the developer shall not enter into any agreement that would encumber or otherwise have any impact on the proposed right-of-way dedications within the planned boundary without the prior written consent of Development Services.


11.              That the developer submit plans for grading, siltation, and erosion control to Development Services for review, acceptance, and permitting prior to beginning any construction activities.

 

12.              That the developer secure a site disturbance permit from Development Services prior to beginning any construction, grading, clearing, or grubbing activities, if the disturbed area equals one acre or more, prior to recording the plat.

 

13.              That the developer secure permits to extend sanitary sewers to ensure individual service is provided to all proposed lots and determine adequacy as required by Development Services, prior to recording the plat.

 

14.              That the developer secure permits to provide a storm water conveyance system to serve all proposed lots within the development and determine adequacy as required by Development Services, prior to recording the plat.

 

15.              That the developer grant a Surface Drainage Easement to the City as required by Development Services, on the final plat.

 

16.              That the developer enter into a covenant agreement for the maintenance of any stormwater detention area tracts as required by Development Services, prior to recording the plat.

 

A copy of the preliminary plat is on file in the office of the City Clerk with this ordinance and is made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed preliminary plat hereinabove, all public notices and hearings required by the Subdivision Regulations have been given and had.
