ORDINANCE NO. 950568

 

Amending Chapter 65, Revised Ordinances of Kansas City, Missouri, 1956, commonly known as the Zoning Ordinance, by adding a new section to be known as Section 65.010A2587, rezoning an area of approximately 1.57 acres generally located at the northeast corner of N.E. 83rd Street and N. Indiana Avenue from District R-1a (One-Family Dwellings) to District CP-1 (Neighborhood Planned Business Center), and approving a preliminary plan for the same. (11633-CP)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Chapter 65, Revised Ordinances of Kansas City, Missouri, 1956, commonly known as the Zoning Ordinance, is hereby amended by enacting a new section to be known as Section 65.010A2587, rezoning an area of approximately 1.57 acres generally located at the northeast corner of N.E. 83rd Street and N. Indiana Avenue from District R-1a (One-Family Dwellings) to District CP-1 (Neighborhood Planned Business Center), said section to read as follows:

 

Section 65.010A2587. That an area legally described as:

 

All of Lots 113, 114, 115, 116 and 117, GRAGG ACRES, a subdivision of land in Kansas City, Clay County, Missouri, except that part being used for right of way for Missouri Route 152, as now established, being bounded and described as follows: Beginning at the northwest corner of said Lot 117, thence South 88 07'20" East, along the north line of Lots 117, 116, and 115, said line being also the southerly line of said Missouri Route 152, 249.02 feet to the northeast corner of said Lot 115; thence South 77 49'50" East along said southerly right of way, 169.80 feet to a point on the east line of said Lot 113; thence South 0 08'01" West, along said east line, 136.99 feet to the southeast corner thereof; thence North 89 10'43" West, along the south line of said Lots 113 through 117, 415.00 feet to the southwest corner of said Lot 117; thence North 0 08'01" East, along the west line of said Lot 117, 175.00 feet to the point of beginning. Containing 1.57 acres, more or less.

 

is hereby rezoned from District R-1a (One-Family Dwellings) to District CP-1 (Neighborhood Planned Business Center), all as shown outlined on a map marked Section 65.010A2587, which is attached hereto and made a part hereof, and which is hereby adopted as a part of an amendment to the zoning maps constituting a part of said chapter and as an amendment to Section 65.010 thereof.

 

Section B. That a preliminary plan for the area legally described above is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, as amended,

commonly known as the Subdivision Regulations.

 

2. That the developer submit a storm drainage study to the City Engineer's Office for approval and that the developer make any needed improvements required by the City

Engineer's Office.

 

3. That the developer submit plans for grading and siltation and erosion control to the City Engineer's Office for approval prior to the commencement of any construction

activities.

 

4. That the developer provide for fire protection as required by the Fire Department.

 

5. That the developer extend water mains as required by the Water Department.

 

6. That the developer extend sanitary sewers as required by the Pollution Control Department.

 

7. That the developer dedicate additional right of way for N.E. 83rd Street as required by the Department of Public Works so as to provide 30 feet of right of way as

measured from the centerline of N.E. 83rd Street.

 

8. That the developer improve one-half of N.E. 83rd Street to collector street standards.

 

9. That the developer contribute a proportionate share of the cost of the installation of a traffic signal at Missouri Route 1 and N.E. 83rd Street as required by the Missouri

Highway and Transportation Department, and subject to a traffic study as approved

by the Missouri Highway and Transportation Department.

 

10. That the developer secure approval from the Missouri Highway and Transportation Department prior to working in any State right of way.

 

11. That the developer submit a final plan to the City Plan Commission for approval, including information on signage, landscaping, and screening.

 

A copy of said preliminary plan is on file in the office of the City Clerk under Document No. 950568, which is attached hereto and made a part hereof.

 

Section C. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
