Authorizing the City Manager to execute a Cooperative Park Development Agreement with Platte County and approving the purchase and acceptance of deed for property on the west side of Platte Purchase Road between N.W. 100th Street and N.W. 108th Street; reduce appropriations in the Capital Improvements Fund in the amount of $8,000.00 and appropriating it to an account in the Capital Improvements Fund for park improvements at Tiffany Hills Park in the Second Council District; and directing the City Clerk to file this ordinance and Cooperative Park Development Agreement in Platte County.

 

WHEREAS, the Board of Parks and Recreation approved a Memorandum of Understanding with Platte County to jointly acquire and develop a 140 acre tract for recreational purposes; and,

 

WHEREAS, Platte County purchased 140 acres and the Board of Parks and Recreation wishes to purchase 60 acres to meet the City's parks and open space requirements for this area; and

 

WHEREAS, the 60 acres the Board of Parks and Recreation wishes to purchase has been appraised at a value of $270,000.00 ($4,500.00 an acre) and that Platte County has agreed to accept $270,000.00 for the 60 acres; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the City Manager is hereby authorized to execute the Cooperative Park Development Agreement with Platte County. The Agreement will commit the City to spend from non-general fund sources $1,500,000.00 to develop this park land subject to appropriations. The Agreement will be in a form substantially as that on file in the office of the Parks and Recreation Department.

 

Section 2. That the appropriation in the following account of the Capital Improvements Fund is hereby reduced by the following amount:

 

05-3090-896201-89009996 Special Projects Council District 2/ CD2 Contingency $8,000.00

 

Section 3. That the sum of $8,000.00 is hereby appropriated from the Unappropriated Fund Balance of the Capital Improvements Fund to the following account in the Capital Improvements Fund:

 

05-3090-706270-B Platte Purchase Park/ Platte Purchase Acquisition $8,000.00

 

Section 4. That the Board of Parks and Recreation is hereby authorized to purchase 60 acres in the amount of $270,000.00 from funds previously appropriated in the following accounts: 3090-706261 - Platte Purchase Park for $89,392.00, 3090-706270 - Platte Purchase Park for $107,408.00; 3391-707257 - Platte Purchase Park Land Acquisition for $73,200.00 for the property located on the west side of Platte purchase Road between N.W. 100th Street and N.W. 108th Street the property, legally described as follows:

 

TRACT ONE: All of the West one-half of the Southeast Quarter of the Northeast Quarter of said Section 33, Township 52, Range 33, Kansas City, Platte County, Missouri.

 

TRACT TWO: All of the Northeast Quarter of the Northeast Quarter of Section 33, Township 52, Range 33, in Kansas City, Platte County, Missouri

 

Section 5. That the City Clerk is hereby directed to record a copy of this ordinance and a copy of the Cooperative Park Development Agreement and file same in the Recorder of Deeds Office in Platte County, Missouri.

I hereby certify that there is a balance, otherwise unencumbered, to the credit of the appropriation to which the foregoing expenditure is to be charged, and a cash balance, otherwise unencumbered, in the treasury, to the credit of the fund from which payment is to be made, each sufficient to meet the obligation hereby incurred.
