ORDINANCE NO. 150360, AS AMENDED

 

Approving the Frontage at Executive Park Area General Development Plan on approximately 60 acres generally located on either side of N. Corrington Avenue, north of E. Front Street, and declaring the area an Undeveloped Industrial Area in need of development pursuant to The Planned Industrial Expansion Law. (718-S)

 

WHEREAS, the Planned Industrial Expansion Authority of Kansas City, Missouri (“Authority”) did prepare or cause to be prepared the Frontage at Executive Park Area General Development Plan (“General Development Plan”) and recommended that the Council approve the finding of Undeveloped Industrial Area and approve the General Development Plan for the area; and

 

WHEREAS, the City Plan Commission reviewed the General Development Plan on April 21, 2015, and forwarded its recommendation that the General Development Plan be approved, and made no recommendation with regards to finding the property to be an Undeveloped Industrial Area or the conformity of the General Development Plan with the general plan for the development of the community as a whole; and

WHEREAS, Section 100.400, RSMo, authorizes the Council to approve the General Development Plan and make a finding of an Undeveloped Industrial Area if the Council finds that the General Development Plan is feasible and in conformity with the general plan for the development of the community as a whole; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the Council declares the area of approximately 60 acres generally located on either side of N. Corrington Avenue, north of E. Front Street, and more specifically described by metes and bounds as follows:

 

TRACT 1: A tract of land located in the East Half of Section 24, Township 50, Range 33, in Kansas City, Jackson County, Missouri, said land being an accretion, projecting from the original Section 25, Township 50, Range 33, as well as, possibly, from the original Sections 23 and 26 of said Township 50, Range 33, as well as, possibly, from the original Section 30, in Township 50, Range 32, all more particularly described as follows: Commencing at the northwest corner of tract a, as platted on Executive Park, 28th Plat, according to the recorded plat thereof; thence North 2 degrees 26 minutes 17 seconds East, along the east right of way line of interstate Highway No. 435, as now established, a distance of 1,404.38 feet, to the point of beginning; thence continuing North 2 degrees 26 minutes 17 seconds East, along said easterly highway right of way line, a distance of 1,840.89 feet, to a point on the southerly line of the Missouri River Levee right of way; thence along said levee right of way, on a curve


to the right, the initial tangent to which bears South 70 degrees 15 minutes 39 seconds East, radius of said curve being 5,936.22 feet, with a central angle of 11 degrees 08 minutes 40 seconds, an arc distance of 1,154.64 feet; thence South 1 degree 55 minutes 27 seconds West, a distance of 1,383.15 feet; thence North 88 degrees 04 minutes 33 seconds West, a distance of 1,074.62 feet to the point of beginning.

 

TRACT 2: A tract of land located in the East Half (E 1/2) of Section 24, Township 50, Range 33, in Kansas City, Jackson County, Missouri, said land being an accretion, projecting from the original Section 25, Township 50, Range 33, as well as possibly, from the original Sections 23 and 26 of said Township 50, Range 33 and as well as, possibly, from the original Section 30, in Township 50, Range 32, all more particularly described as follows: Commencing at the northwest corner of tract a, as platted on Executive Park, 28th Plat, according to the recorded plat thereof; thence North 2 degrees 26 minutes 17 Seconds East, along the east right of way line of interstate Highway No. 435 as now established, a distance of 1404.38 feet; thence South 88 degrees 04 minutes 33 seconds East, a distance of 604.62 feet, to the point of beginning; thence continuing South 88 degrees 04 minutes 33 seconds East, a distance of 60.00 feet; thence South 1 degree 55 minutes 27 seconds West, a distance of 1404.32 feet, to the northwest corner of Tract D of said 28th Plat; thence North 88 degrees 04 minutes 33 seconds West along the north line of said 28th Plat, a distance of 60.00 feet; thence north 1 degree 55 minutes 27 seconds East, a distance of 1404.32 feet to the point of beginning.

 

A portion of the above described legal description has been dedicated for public use as N. Corrington Avenue by the recorded plat of Executive Park Fifty-Sixth Plat, recorded April 4, 2000, as Document No. 2000K-0018198, in Plat Book K-40, page 14 and has been accepted by the City of Kansas City under Ordinance No. 991503, recorded April 4, 2000, as Document No. 2000K-0018197.

 

TRACT 3: A parcel of land located in part of Section 24 and 25, Township 50 North, Range 33 West, in Kansas City, Jackson County, Missouri, described as follows: Commencing at the southeast corner of the Northeast 1/4 of the Northeast 1/4 of said Section 25; thence due north along the east line of said 1/4 1/4 Section, 100.0 feet; thence North 89 degrees 38 minutes 20 seconds West parallel with the south line of said 1/4 1/4 Section, 15.0 feet to a true point of beginning; thence North 89 degrees 38 minutes 20 seconds West 827.64 feet to a point on the easterly right-of-way line of interstate Highway No. 435, as now established; thence northerly along said right-of-way line the following described courses: North 29 degrees 37 minutes 40 seconds West 164.42 feet, North


10 degrees 04 minutes 36 seconds West 720.54 feet; North 6 degrees 13 minutes 34 seconds West 553.26 feet, North 0 degrees 30 minutes sd seconds East 4110.20 feet to a point on the southerly line of Missouri River Levee right-of-way; thence southeasterly along said southerly line on a curve to the right initial tangent bearing of South 72 degrees 11 minutes 01 seconds East, an arc distance of 1154.61 feet to a point 15.0 feet west of the east line of said Section 24; thence due south 15.0 feet west of and parallel to the east line of said Sections 24 and 25, 5059.99 feet to the point of beginning, except that part in public streets and except that part released by partial deed of release recorded with the Recorder of Deeds of Jackson County, Missouri as Document No. K-241071, in Book K-550, page 296 at Kansas City and as Document No. I-197684 in Book K-558, page 1139 at Independence, Jackson County, Missouri.

 

Also less and except all that part platted as Executive Park 18th Plat, Executive Park 28th Plat, Executive Park 56th Plat, Executive Park Twenty-Eighth Plat a Replat of Lot Split Tract A-1 of Tract A and except that part described and conveyed by Quit Claim Deed filed as Document No. 2010E0121207.

 

to be an Undeveloped Industrial Area in need of industrial development as defined in Section 100.310, RSMo, and that such conditions retard economic or social growth, are economic waste and social liabilities, and represent an inability to pay reasonable taxes to the detriment and injury of the public health, safety, morals and welfare, and that the elimination of the detrimental conditions in such area by the commercial development of such area is necessary and in the interest of the public health, safety, morals, economy and welfare of such residents.

 

Section 2. That the Frontage at Executive Park Area General Development Plan with such revisions as were recommended by the City Plan Commission is hereby approved with respect to the real property described in Section 1.

 

Section 3. That the Council has duly made the findings necessary for compliance with Section 100.300-100.620, RSMo.

 

Section 4. That the General Development Plan is hereby found to be feasible and in conformance with the general plan for the development of the community as a whole.

 

Section 5. That the ad valorem tax exemption benefits as authorized in Section 100.570, RSMo, are hereby extended to the plan area to the extent and in the manner as provided for in said General Development Plan, and subject to the execution of a development agreement with the Planned Industrial Expansion Authority of Kansas City, Missouri, and the developer.
