COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 061425

 

Approving the First Amendment to the General Development Plan for the Southwest Boulevard Redevelopment Area by deleting a requirement that a certain billboard be removed from the area; finding the First Amendment to be in compliance with Sections 100.300-100.620, RSMo; and approving the ad valorem tax benefits therefor.

WHEREAS, the Planned Industrial Expansion Authority of Kansas City, Missouri did prepare or cause to be prepared a General Development Plan for the Southwest Boulevard Redevelopment Area and recommended that the Council approve the finding of blight and approve the General Development Plan for the area; and

WHEREAS, the City Plan Commission reviewed and recommended approval of the finding of blight and of the General Development Plan for the Southwest Boulevard Redevelopment Area on August 17, 2004, and found said plan to be in conformance with the general plan for the development of the community as a whole; and

WHEREAS, said area was declared to be blighted by the City Council through passage of Ordinance No. 041045 on November 4, 2004, and a General Development Plan was approved for the area known as the Southwest Boulevard Redevelopment Area; and

 

WHEREAS, the City Plan Commission reviewed and recommended approval of the First Amendment to the General Development Plan for the Southwest Boulevard Redevelopment Area on January 2, 2007, and has found said amendment to be in conformance with the general plan for development of the community as a whole; NOW, THEREFORE,

 

BE IT RESOLVED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the First Amendment to the General Development Plan for the Southwest Boulevard Redevelopment Area, as shown in the First Amendment to the General Development Plan dated January 2, 2007, is hereby approved; subject to the following condition:

 

That the Southwest Boulevard Redevelopment Area (PIEA) plan retain the current language regarding billboards but be modified as follows: Proposed Revision (changes shown in bold):

 

Additional Features

No heavy industrial uses or outdoor storage will qualify for any benefits under the plan. Two billboards (Outdoor Advertising, Off-Premises Sign) currently exist within the proposed redevelopment area (Dean, Map ID - #20 and Schutte, Map ID - #28). In exchange for tax abatement on any tracts owned by the owner or lease holder of a billboard, the developer agrees to remove the billboard after the expiration of the existing lease agreement or within 5 years of approval of the Plan, whichever occurs first, and no new billboards within the area will be allowed.

 

Note that this restriction regarding the withholding of tax abatement based upon the ownership or lease agreement on a billboard does not apply to the existing or any future billboard located at 1801 Bi-State Road and identified as Dean, Map ID- #20 in the PIEA Plan.

 

. A copy of said First Amendment to the General Development Plan for the Southwest Boulevard Redevelopment Area is attached hereto and incorporated herein by reference with this ordinance.

 

Section 2. That this Council has duly made the findings necessary for compliance with Sections 100.300 through 100.620, RSMo.

 

Section 3. That said First Amendment to the General Development Plan for the Southwest Boulevard Redevelopment Area is hereby found to be feasible and in conformance with the general development plan for the community as a whole.

 

Section 4. That the ad valorem tax exemption benefits as authorized in Section 100.570, RSMo, are hereby extended to the plan area, as amended by the First Amendment, to the extent and in the manner provided for in said First Amendment to the General Development Plan for the Southwest Boulevard Redevelopment Area, subject to the execution of a development agreement with the Authority.
