COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 100048

Authorizing the Director of Public Works to execute a cooperative agreement with the City of Lake Waukomis, Missouri and the Lake Waukomis Association, Inc. regarding the detachment of approximately 10.33 acres generally bounded by North Green Hills Road/N.W. Waukomis Drive on east, Platte Brooke Drive on the north, NW 72nd Terrace on the south, and the City of Lake Waukomis on the west, and regarding the dedication of street right of way and easements necessary for the re-construction of Waukomis Drive and Green Hills Road; and detaching that area upon the annexation of said property by the City of Lake Waukomis.

WHEREAS, Lake Waukomis was incorporated in 1956; and

WHERAS, the City of Kansas City with the passage of ordinance 20190 annexed a large portion of Platte County including all land around Lake Waukomis in 1962; and

WHEREAS, the Lake Waukomis Association, Inc. owns property within the City of Kansas City municipal boundaries; and

WHEREAS, the property is located below the impoundment facility for Lake Waukomis and is located inside the FEMA 100-year floodplain boundary and regulated floodway restricting the development of the property; and

WHEREAS, the City of Lake Waukomis has used this property for green space preservation; and

WHEREAS, the City of Kansas City has determined that providing basic services to property generally bounded by Waukomis Drive on east, Platte Brooke Drive on the north, NW 72nd Terrace on the south, and the City of Lake Waukomis on the west is inefficient; and

WHEREAS, the City of Kansas City and the City of Lake Waukomis agree that providing basic services to property generally bounded by Waukomis Drive on east, Platte Brooke Drive on the north, NW 72nd Terrace on the south, and the City of Lake Waukomis on the west is better addressed by a single city; and

WHEREAS, the City of Kansas City has been working on improvements to Waukomis Drive and the City of Lake Waukomis and the Lake Waukomis Association, Inc. support the project; and

WHEREAS, the Lake Waukomis Association, Inc. would provide the right of way and easements for the Waukomis Drive project at no cost to the taxpayers of Kansas City, Missouri; and


WHEREAS, in the spirit of cooperation and good faith all parties want to see Waukomis Drive improved; and

WHEREAS, there are no residents living in the area to be dettached; and

WHEREAS, it is the intent of the City of Kansas City to deannex 10.33 acres generally bounded by Waukomis Drive on east, Platte Brooke Drive on the north, N.W. 72nd Terrace on the south, and the City of Lake Waukomis on the west so that it may be concurrently annexed by the City of Lake Waukomis according to the terms of Section 71.011, Revised Statutes of Missouri; NOW, THEREFORE

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

Section 1. That the following property, generally bounded by Waukomis Drive on east, Platte Brooke Drive on the north, N.W. 72nd Terrace on the south, and the City of Lake Waukomis on the west is hereby detached from the City of Kansas City, Missouri upon the annexation of the same property by the City of Lake Waukomis according to the terms of Section 71.011, Revised Statutes of Missouri; which property is more specifically described as follows:

A tract of land situated in the Southeast Quarter and the Southwest Quarter of Section 17, Township 51 North, Range 33 West of the Fifth Principal Meridian in the City of Kansas City, Platte County, Missouri, said tract being more particularly described as follows:

(Note: The bearing system in the following description is based on Grid North, Missouri Coordinate System of 1983/97).

Commencing at the Southwest corner of the Southeast Quarter of said Section 17; thence North 00 degrees 46 minutes 14 seconds East, 508.90 feet, along the west line of the Southeast Quarter of said Section 17, to the southeast corner of a certain tract of land conveyed by Warranty Deed recorded in Book 218 at page 643 and the southwest corner of a certain tract of land conveyed by Warranty Deed recorded in Book 563 at page 2, said point also being the “true point of beginning”; thence North 88 degrees 52 minutes 15 seconds West, 151.33 feet, along the south line of said certain tract of land conveyed by Warranty Deed recorded in Book 218 at page 643, to the southwest corner of said certain tract of land conveyed by Warranty Deed recorded in Book 218 at page 643; thence North 00 degrees 46 minutes 14 seconds East, 787.50 feet, along the westerly line of said certain tract of land conveyed by Warranty Deed recorded in Book 218 at page 643; thence South 88 degrees 52 minutes 15 seconds East, 151.33 feet, along said westerly line, to a point being on the west line of the Southeast Quarter of said Section 17; thence North 00 degrees 46 minutes 14 seconds East, 11.09 feet along said west line; thence North 88 degrees 51 minutes 12 seconds West, 51.33 feet along said Westerly line; thence North 00 degrees 46 minutes 14 seconds East, 411.50 feet, along said westerly line, to the southwest corner of a certain tract of land conveyed by Warranty Deed recorded in Book 733 at page 615; thence North 84 degrees 02 minutes 32 seconds East, 122.09 feet, along the southerly line of said certain tract of land conveyed by Warranty Deed recorded in Book 733 at page 615, to a point on the proposed westerly right-of-way line of N.W. Waukomis Drive (Route AA Highway); thence South 07 degrees 08 minutes 34 seconds East, 215.37 feet, along said proposed westerly right-of-way line, to the beginning of a curve concave to the east having a radius of 1,100.00 feet; thence southerly 257.18 feet, along said proposed westerly right-of-way line and said curve to the left having a chord bearing South 13 degrees 50 minutes 26 seconds East, 256.60 feet, to a jog in said proposed westerly right-of-way line, said point also being on the west line of a certain tract of land conveyed by Warranty Deed recorded in Book 937 at page 301; thence South 00 degrees 46 minutes 47 seconds West, 97.20 feet, along said proposed westerly right-of-way line and the west line of said certain tract of land conveyed by Warranty Deed recorded in Book 937 at page 301, to a point being on the proposed southwesterly right-of-way line of N.W. Waukomis Drive (Route AA Highway); thence South 47 degrees 43 minutes 41 seconds East, 114.41 feet, along said proposed southwesterly right-of-way line, to a point being the beginning of a non-tangent curve concave to the northeast having a radius of 1,100.00 feet; thence southeasterly 338.98 feet along said proposed southwesterly right-of-way line and said curve to the left having a chord bearing South 39 degrees 26 minutes 07 seconds East, 337.64 feet; thence South 48 degrees 15 minutes 48 seconds East, 219.99 feet, along said proposed southwesterly right-of-way line, to a point being on the southeasterly line of said certain tract of land conveyed by Warranty Deed recorded in Book 563 at page 2; thence South 74 degrees 15 minutes 14 seconds West, 661.32 feet, along said southeasterly line, to the “true point of beginning” of the tract herein described, containing 450,084 square feet or 10.3325 acres, more or less. Subject to all easements and restrictions of record.

A tract of land situated in the Southeast Quarter of Section 17, Township 51 North, Range 33 West of the Fifth Principal Meridian in the City of Kansas City, Platte County, Missouri, lying wholly within a certain tract of land conveyed by Warranty Deed recorded in Book 733 at Page 615 and lying west of the following described line:

Commencing at the Southwest corner of Lot D, Block A, “Amended Map of Lake Waukomis”, a subdivision of land in the City of Lake Waukomis, Platte County, Missouri, according to the recorded plat thereof, said point also being the Northwest corner of a certain tract of land conveyed by Warranty Deed recorded in Book 733 at Page 615; thence North 84 degrees 55 minutes 15 seconds East 82.51 feet, along the Southerly line of said Lot D and the Northerly line of said certain tract of land conveyed by Warranty Deed recorded in Book 733 at Page 615, to the “true point of beginning”; thence South 07 degrees 08 minutes 34 seconds East 139.58 feet more or less to the point of terminus, said point being on the southern line of said tract of land, containing 12,944 square feet or 0.30 acres, more or less. Subject to all easements and restrictions of record.

Section 2. That the reason for and purpose to be accomplished with this concurrent detachment by the City of Kansas city and annexation by Lake Waukomis is that such action will allow for better coordination of utility service and maintenance for the benefit of the citizens and property owners in the affected area.

Section 3. The City of Lake Waukomis shall file a certified copy of this ordinance simultaneously with the filing of a certified copy of the related annexation ordinance adopted by the City of Lake Waukomis in the office of the County Clerk of Platte County, the Platte County assessor, the Recorder of Deeds of Platte County, and the Clerk of the Circuit Court of Platte County, at the cost of the City of Lake Waukomis.

Section 4. That the Director of Public Works is authorized to enter into a cooperative agreement with the City of Lake Waukomis and the Lake Waukomis Association, Inc. for the dedication of street right of way and easements necessary for the re-construction of Waukomis Drive and Green Hills Road. The agreement shall be in a form substantially similar to that attached hereto and incorporated herein.
