COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 910278

 

Amending Chapter 65, Revised Ordinances of Kansas City, Missouri, 1956, commonly known as the Zoning Ordinance, by adding a new section to be known as Section 65.010A2372, rezoning an area of approximately 25 acres located on the west side of I-35 at N.E. 56th Street (extended) from District R-1a (One-Family Dwelling - Medium Density) to District C-2-p (Local Retail Business - Limited District), and approving a preliminary plan for the same. BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Chapter 65, Revised Ordinances of Kansas City, Missouri, 1956, commonly known as the Zoning Ordinance is hereby amended by enacting a new section to be known as Section 65.010A2372, rezoning an area of approximately 25 acres located on the west side of I-35 at N.E. 56th Street (extended) from District R-1a (One-Family Dwelling - Medium Density) to District C-2-p (Local Retail Business - Limited District), said section to read as follows:

 

Section 65.010A2372. That an area legally described as:

 

All that part of the Southwest Quarter of Section 28, Township 51, Range 32 and part of the Southeast Quarter of Section 29, Township 51, Range 32 in the City of Kansas City, Clay County, Missouri, being more particularly described as follows: Beginning at the Southwest corner of said Section 28; thence South 8938'47" East along the South line of said Section 28, a distance of 28.98 feet to its intersection with the westerly right of way line of Interstate Route No. 35; thence North 3149'01" East along said westerly right of way line, a distance of 251.08 feet (deed) 250.27 feet (measured) thence continuing along said westerly right of way line North 5810'59" West, 35.00 feet; thence continuing along said westerly right of way line North 3149'01" East, 300.00 feet (deed) 300.23 feet (measured) to the true point of beginning for the herein described Tract "A"; thence North 5810'59" West, 230.00 feet (deed) 231.21 feet (measured); thence South 6553'05" West, a distance of 253.10 feet; thence North 4225'30" West, a distance if 82.50 feet; thence North 4617'14" East, a distance of 540.43 feet; thence North 0428'02" East, a distance of 641.95 feet; thence North 3053'35" East, a distance of 522.99 feet; thence due North a distance of 250.00 feet (deed) 255.08 feet (measured) to a point on the South line of "Maple Park Gardens"; thence South 8933'54" East (deed) North 8940'34" East (measured) along the South line of said "Maple Park Gardens", a distance of 775.71 feet (deed) 773.08 feet (measured) to its intersection with the City limits of Kansas City, also being the westerly right of way line of Eugene Field Road; thence South 0002'05" West along said westerly right of way line a distance of 258.28 feet (deed) 285.18 feet (measured) to its intersection with the westerly right of way line of Interstate Route No. 35; thence southwesterly along said right of way line on a curve to the left, having a radius of 2,939.79 feet, a tangent bearing of South 3741'13" West (deed) South 3736'21" West (measured) an arc length of 307.61 feet (deed) 297.02 feet (measured); thence South 3149'01" West continuing along said westerly right of way line 418.40 feet; thence South 5120'44" West continuing along said westerly right of way line, a distance of 74.33 feet; thence South 3149'01": West continuing along said westerly right of way line 730.00 feet; thence South 3724'03" West continuing along said right of way line 100.50 feet; thence South 3149'01" West continuing along said right of way line 200.00 feet (deed) 199.77 feet (measured) to the true point of beginning.

 

is hereby rezoned from District R-1a (One-Family Dwelling - Medium Density) to District C-2-p (Local Retail Business - Limited District), all as shown outlined on a map marked Section 65.010A2372, which is attached hereto and made a part hereof, and which is hereby adopted as a part of an amendment to the zoning maps constituting a part of said chapter and as an amendment to Section 65.010 thereof.

 

Section B. That a preliminary plan for the area legally described above is hereby approved, subject to the following conditions:

 

1. That the developer dedicate right of way for public street (N.E. Oakridge) leading to the subject property.

 

2. That the developer improve the public right of way leading to the property with an asphalt street 20 feet in

width to type F City standards and enter into a deferral

agreement to construct curbs on the east side only at the

time development occurs on the property abutting such

public right of way.

 

3. That the developer submit a storm drainage study to the City Engineer including provision for any needed

improvements.

 

4. That the developer secure floodplain certificate prior to the commencement of any work within the floodplain.

 

5. That the developer cause the area to be platted and processed in accordance with Chapter 31, Code of General

Ordinances of Kansas City, Missouri, commonly known as

the Subdivision Regulations.

 

6. That the developer submit a final plan for review and approval by the City Plan Commission prior to the

commencement of construction.

 

A copy of said preliminary plan is on file in the Office of the City Clerk under Document No. 910278, which is attached hereto and made a part hereof.

 

Section C. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
