COMMITTEE SUBSTITUTE FOR RESOLUTION NO. 080901

 

Approving an amendment to the 63rd Street Corridor Plan by changing the Conceptual Land Use Plan for the east side of Prospect Avenue between 59th Street on the north and 63rd Street on the south from Park and Open Space to Commercial and also an area generally defined as being from about 300 feet west of Prospect Avenue between 59th Street on the north and a distance of about 1,240 feet south of 59th Street on the south from Low-Medium Density Residential to Mixed Use Residential/Commercial/Office/ Institutional (except for that area currently defined as Park or Open Space). WHEREAS, after review by the City Development Department it has been deemed appropriate to adopt the First Amendment to the 63rd Street Corridor Land Use and Development Plan which is a guide for the future development and redevelopment for the area generally bounded by Wornall Road on the west, Bruce R. Watkins Drive (U.S. Highway 71) on the east, 59th Street on the north and Meyer Boulevard on the south; and

 

 WHEREAS, public notice of the hearing on the First Amendment to the 63rd Street Corridor Land Use and Development Plan before the City Plan Commission was be published on September 1, 2008; and

 

WHEREAS, after all interested persons were given an opportunity to present testimony at the City Plan Commission hearing on September 16, 2008, the City Plan Commission considered and recommended adoption of the First Amendment to the 63rd Street Corridor Land Use and Development Plan on September 16, 2008; NOW, THEREFORE,

 

BE IT RESOLVED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That the First Amendment to the 63rd Street Corridor Land Use and Development Plan is hereby adopted which will amend the portion of that plan as a guide for the future development and redevelopment for that area generally on the east side of Prospect Avenue between 59th Street on the north and 63rd Street on the south and also an area generally defined as being from about 300 feet west of Prospect Avenue between 59th Street on the north and a distance of about 1,240 feet south of 59th Street on the south. A copy of the 63rd Street Corridor Land Use and Development Plan is attached hereto, in substantial form, and is hereby approved.

 

Section B. This amendment will change the planned uses by changing the Conceptual Land Use Plan for the east side of Prospect Avenue between 59th Street on the north and 63rd Street on the south from Park and Open Space to Commercial, and also an area generally defined as being from about 300 feet west of Prospect Avenue between 59th Street on the north and a distance of about 1,240 feet south of 59th Street on the south from Low-Medium Density Residential to Mixed Use Residential/ Commercial/Office/Institutional (except for that area currently defined as Park or Open Space).

 

Section C. That the First Amendment to the 63rd Street Corridor Land Use and Development Plan is consistent and complies with the FOCUS Kansas City Plan, adopted on October 30, 1997, by Committee Substitute for Resolution No. 971268, and is adopted as a supplement to the FOCUS Kansas City Plan.

 

Section D. That the Council finds and declares that before taking any action on the proposed First Amendment to the 63rd Street Corridor Land Use and Development Plan hereinabove, all public notices and hearings required by law have been given and had.
