COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 051292

 

Rezoning an area of about 91 acres generally bounded by 17th Street and 21st Street on the north, the Kansas City Terminal Railroad, Allen Avenue and Division Street on the west, 25th Street and a line about 100 feet north of 24th Street on the south, and Holly Street and Jefferson Street on the east, to consider rezoning from Districts R-2b, R-4, C-2, M-1, and M-2b to Districts R-1b and R-2b.

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Chapter 80, Code of Ordinances of the City of Kansas City, Missouri, commonly known as the Zoning Ordinance, is hereby amended by enacting a new section to be known as Section 80-11A0652, rezoning an area of approximately 91 acres generally bounded by 17th Street and 21st Street on the north, the Kansas City Terminal Railroad, Allen Avenue and Division Street on the west, 25th Street and a line about 100 feet north of 24th Street on the south, and Holly Street and Jefferson Street on the east from Districts R-2b (Two-Family Dwellings), R-4 (Low Apartments), C-2 (Local Retail Business), M-1 (Light Industry), and M-2b (Heavy Industry, Non-Residential) to Districts R-1b (One-Family Dwellings) and R-2b (Two-Family Dwellings), said section to read as follows:

 

Section 80-11A0652. That an area legally described as:

 

That portion of the southeast 1/4 of the southwest 1/4 of Section 6 Township 49 North Range 33 West described as follows: Beginning at the southeast corner of the southwest 1/4 said Section 6, thence north 25 feet thence west 120.25 feet thence south 25 feet thence east 120.25 feet to the point of beginning; and Lots 1-9 inclusive and Lots B, C, D and E, Block 1, Resurvey of Whipples 2nd Addition; and

 

Lot A and Lots 132-153 inclusive, Block 1, and Lots 155-199 inclusive, Block 5, and Lots 203-251 inclusive, Block 2, Resurvey of Whipples 2nd Addition, and all of Lots 1-22 and Lot 36 of Morses 2nd Addition, and all of vacated Allen Avenue and vacated Terrace Street and vacated Franklin Street adjacent said lots; and

 

Lots F & G, Lots 10-20 and Lots 26-66 and Lots 201-202 inclusive, Block 2 of the Resurvey of Whipples 2nd Addition, and Lots 1-15 Inclusive, Block 1 of Morses 1st Addition; and

 

Lots 67-105 inclusive, and Lot H and Lot K, Block 3, Resurvey of Whipples 2nd Addition; and

 


Lots 1-21 inclusive, Block 2, Morse's 1st Addition, and Lots 106-131 inclusive, Block 4, Resurvey of Whipples 2nd Addition; and

 

Lots 1-6 inclusive, Lots 8-17 inclusive and Lots 40-48 inclusive of Reservoir Place, Lots 1-23 inclusive of Holly Place, and the north 70 of Lots 24-28 inclusive, the eastern 5 of the north 70 of Lot 29, and the eastern of vacated Mercier Terrace lying west of and adjacent said Lots 15-23 inclusive and Lot 29, Holly Place; and

 

Lots 1-24 inclusive, Block 28 of Winters Addition, and Lots 25-48 Inclusive, Block 27 of Winters Addition, including those lots and portions of lots established as Tracts 1 and 2, Certificate of Survey filed as Document #K527591, Book S-1, Page 163, Lots 1-48 inclusive Wheatland Addition, except that portion in right-of-way and all vacated Jarboe Street and all vacated alleys adjacent said lots; and

 

Tracts A and B as established by Certificate of Survey filed as Document #K1175231, Book S5, Page 5, and Lots 49-55 and Lots 60-72 inclusive, Block 26 Winters Addition, and Lots 1-10 and 13-20 inclusive, Thayers Addition; and

 

Lots 73-93 inclusive, Block 25 Winters Addition and Lots 1-17 inclusive, Block 2, Thayers Addition; and

 

Lots 12 24 inclusive, F. J. Bairds Addition; and

Lots A-E inclusive, Resurvey Of Lots 1 & 2 In Block 1 Fairmount Park, and Lots 3-17 inclusive and the N 16 2/3 feet of Lot 18, Block 1 of Fairmount Park, and Lots 1-13 inclusive and the north of the vacated alley lying south and adjacent said Lot 13, and Lots 23-49 Inclusive, Mary Troost Addition; and

 

Lots 1-21 inclusive and Lots 30-50 inclusive, Block 2 of Fairmount Park; and

 

Lots 1-22 inclusive and Lots 30-50 inclusive, Block 3 of Fairmount Park; and

 

Lots 1-50 inclusive. Block 4, and Lots 18-33 inclusive, Block 5, and Lots 1-15 inclusive and Lots 17-50 inclusive, Block 6, and Lots 6, 7 and 29, Block 7, and Lot 1-19 inclusive and Lots 21-24 inclusive, Block 8, and Lots 1-29 inclusive, Block 9, Fairmount Park, and Lots 1-5 inclusive and Lots 25-29 inclusive, Office Park, and all vacated streets and alleys adjacent said lots; and

 

Lots 1-15 inclusive and Lots 36-50 inclusive, Block 5 of Fairmount Park; and

 

Lots 1-15 Inclusive and Lots 20-25 inclusive, Block 14, Winter & Coates Subdivision of Blocks 12 and 13, Fairmount Park Subdivision, except that portion in right of way, and Lots 1-11 inclusive Block 15, Winter & Coates Subdivision of Blocks 12 and 13, Fairmount Park Subdivision, except that portion in right of way, and a tract described as follows: Beginning at the southwest corner Lot 9, said Block 15, on the east line of Allen Avenue thence southerly along said east line 270 feet to the west line of Fairmount Avenue thence north along said west line 130 feet to the southeast corner Lot 7, said Block 15, then northwesterly to the point of beginning; and

 

Lots 7-12, inclusive, Block 5, South Side Place; and

 

Lots 30 and 31, Jaudons Addition.

 

is hereby rezoned from Districts R-2b (Two-Family Dwellings), R-4 (Low Apartments), C-2 (Local Retail Business), M-1 (Light Industry), and M-2b (Heavy Industry, Non-Residential) to District R-1b (One-Family Dwellings), and that an area legally described as:

 

Lots 20 and 21, Block 1, Thayers Addition; and

 

Lots 49 and 50, Wheatland Addition

 

is hereby rezoned from District R-4 (Low Apartments) to District R-2b (Two-Family Dwellings):

 

All in Sections 6 and 7, Township 49 North, Range 33 West, Kansas City, Jackson County, Missouri

 

all as shown outlined on a map marked Section 80-11A0652, which is attached hereto and made a part hereof, and which is hereby adopted as a part of an amendment to the zoning maps constituting a part of said chapter and as an amendment to Section 80-11 thereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
