ORDINANCE NO. 090957

 

Approving the preliminary plat of Gabriel Condominium in Districts R-5 and R-2a on an approximately 0.75-acre tract of land generally located at the southeast corner of Armour Boulevard and Kenwood Avenue. (SD 1419)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That the preliminary plat of Gabriel Condominium in Districts R-5 (High Apartments) and R-2a (Two-Family Dwellings) on an approximately 0.75-acre tract of land generally located at the southeast corner of Armour Boulevard and Kenwood Avenue, and more specifically described as follows:

 

Lots 1, 2, 3, 4 and 5, except part of Lot 1 taken for Armour Boulevard and except the East 16.00 feet of the South 41.00 feet of Lot 4, Block 4, Kenwood, a subdivision in Kansas City, Jackson County, Missouri, according to the recorded plat thereof, containing 31,411.25 sq. ft. or 0.72 acres, more or less,

 

is hereby approved, subject to the following conditions:

 

1.                  That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, commonly known as the Subdivision Regulations.

 

2.                  That a note be placed on the first sheet of the final plat stating that the remnant parcel created from Lot 4 will be combined with Lot 21 through the means described and administered by Jackson County, within 30 days of recording the final plat.

 

3.                  That the developer secure permits to repair or reconstruct the identified sidewalks, curbs, and gutters as necessary along all development street frontages, as required by Development Services, prior to recording of the final plat.

 

4.                  That the developer submit covenants, conditions and restrictions to Development Services for approval by the Law Department for the maintenance of common elements, prior to recording of the final plat.

 

5.                  That the developer meet the requirements of Section 80-444 for the parking lot screening to the south of the existing parking lot, prior to recording of the final plat.

 

6.                  That the developer obtain approval for a street tree planting plan from the City Forester prior to submittal of the final plat.

 

7.                  That the developer be granted approval for any required variances from the Board of Zoning Adjustment prior to recording of the final plat.(for City Plan Commission). That a x ft. variance to the minimum required right-of-way width of 50 ft. for a minor (local residential) street so as to permit 40 ft. of right-of-way as shown on the development plan is hereby granted.

 

A copy of the preliminary plat is on file in the office of the City Clerk with this ordinance and is made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed preliminary plat hereinabove, all public notices and hearings required by the Subdivision Regulations have been given and had.
