ORDINANCE NO. 910442

 

Amending Chapter 65, Revised Ordinances of Kansas City, Missouri, 1956, commonly known as the Zoning Ordinance, by adding a new section to be known as Section 65.010A2376, rezoning an area of approximately 2.87 acres located at the southeast corner of Meyer Boulevard and Troost Avenue from Districts R-P (Automobile Parking) and C-3a2 (Intermediate Business) to District C-2-p (Local Retail Business - Limited District), and approving a preliminary plan for the same. (3137-P/3)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Chapter 65, Revised Ordinances of Kansas City, Missouri, 1956, commonly known as the Zoning Ordinance is hereby amended by enacting a new section to be known as Section 65.010A2376, rezoning an area of approximately 2.87 acres located at the southeast corner of Meyer Boulevard and Troost Avenue from Districts R-P (Automobile Parking) and C-3a2 (Intermediate Business) to District C-2-p (local retail business - limited district), said section to read as follows:

 

Section 65.010A2376. That an area legally described as:

 

TRACT "A": All that part of the Northwest 1/4 of the Southwest 1/4 of Section 4, Township 48, Range 33, in Kansas City, Jackson County, Missouri, described as follows: Commencing at the intersection of the south right of way line of Meyer Boulevard with the east right of way line of Troost Avenue, as said boulevard and avenue are now established; thence North 9000'00" East, along said south right of way line, a distance of 125.00 feet to the true point of beginning of the tract of land to be herein described, said point also being the northeast corner of a tract of land conveyed to Amoco Oil Company by the instrument recorded as Document No. K-916903 in Book K-2003 at page 1834; thence continuing North 9000'00" East, along said south right of way line, a distance of 245.69 feet; thence South 040'50" East, along a line parallel with said east right of way line, a distance of 159.00 feet; thence South 9000'00" West, parallel with said south right of way line, a distance of 265.69 feet to a point on the east line of the tract described in the aforesaid Document No. K-916903 that is North 040'50" West, a distance of 11.00 feet from the southeast corner thereof; thence along the easterly and southerly lines of said Document No. K-916903, the following bearings and distances; North 040'50" West, parallel with said east right of way line, a distance of 85.00 feet; thence North 9000'00" East, parallel with said south right of way line, a distance of 20.00 feet; thence North 040'50" West, parallel with said east right of way line, a distance of 74.00 feet to the true point of beginning. Containing 40,762 square feet or 0.94 of an acre, more or less. TRACT "B": All that part of the Northwest 1/4 of the Southwest 1/4 of Section 4, Township 48, Range 33, in Kansas City, Jackson County, Missouri, described as follows: Commencing at the intersection of the south right of way line of Meyer Boulevard with the east right of way line of Troost Avenue, as said boulevard and avenue are now established; thence North 9000'00" East along said south right of way line, a distance of 370.69 feet; thence South 040'50" East along a line parallel with said east right of way line, a distance of 159.00 feet to the true point of beginning of the tract of land to be herein described; thence continuing South 040'50" East, along the last said parallel line, a distance of 230.24 feet to a point on a line 200.00 feet north of and parallel with the south line of said 1/4 1/4 Section; thence South 8959'10" West, along last said parallel line, a distance of 370.69 feet to a point on said east right of way line; thence North 040'50" West along said east right of way line, a distance of 219.33 feet, to the southwest corner of aforesaid Document No. K-916903; thence along the southerly and easterly lines of said Document No. K-916903, the following bearings and distances; North 9000'00" East, parallel with said south right of way line, a distance of 105.00 feet; thence North 040'50" West, parallel with said east right of way line, a distance of 11.00 feet; thence departing from said easterly line, North 9000'00" East, a distance of 265.69 feet to the true point of beginning. Containing 84,204 square feet or 1.93 acres, more or less.

 

is hereby rezoned from Districts R-P (Automobile Parking) and C-3a2 (Intermediate Business) to District C-2-p (Local Retail Business - Limited District), all as shown outlined on a map marked Section 65.010A2376, which is attached hereto and made a part hereof, and which is hereby adopted as a part of an amendment to the zoning maps constituting a part of said chapter and as an amendment to Section 65.010 thereof.

 

Section B. That a preliminary plan for the area legally described above is hereby approved, subject to the following conditions:

 

1. That the developer provide for a public or private fire system.

 

2. That the developer submit a storm drainage study to the City Engineer, if required.

 

3. That the developer cause the area to be platted and processed in accordance with Chapter 31, Code of General

Ordinances of Kansas City, Missouri, as amended, commonly

known as the Subdivision Regulations.

 

4. That the developer's first phase of construction include landscaping of the total property.

 

A copy of said preliminary plan is on file in the Office of the City Clerk under Document No. 910442, which is attached hereto and made a part hereof.

 

Section C. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
