ORDINANCE NO. 140246

 

Approving a development plan on about 139 acres generally located on the south side of State Route M-150 Highway, between Prospect Avenue on the west and Botts Road on the east, at E. 149th Street. (14049-P-3)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That a development plan is hereby approved in zoning District M 1-5 (Manufacturing 1-5) to allow for an industrial development for four industrial buildings containing about 2 million square feet generally located on the south side of State Route M-150 Highway, between Prospect Avenue on the west and Botts Road on the east, at E. 149th Street, and more specifically described as follows:

 

Property Description: That portion of the following described real property lying above the top of the Winterset ledge of limestone rock: A tract of land in the Northeast Quarter, Southeast Quarter, Southwest Quarter and Northwest Quarter of Section 34 Township 47 North, Range 33 West of the 5th Principal Meridian in Kansas City, Jackson County, Missouri being bounded and described as follows: Commencing at the Northeast corner of said Northeast Quarter; thence North 86 degrees 31 minutes 23 seconds West, along the North line of said Northeast Quarter, 1591.10 feet; thence South 03 degrees 28 minutes 37 seconds West, 254.35 feet to a point on the Southerly right of way line of Missouri State Highway No. 150 as now established, said point also being the Point of Beginning of the tract of land to be herein described: thence South 86 degrees 24 minutes 47 seconds East, along said Southerly right-of-way line, 66.90 feet; thence South 22 degrees 40 minutes 47 seconds East, 1,777.09 feet; thence North 70 degrees 10 minutes 52 seconds East, 14.14 feet; thence South 22 degrees 41 minutes 48 seconds East, 135.00 feet; thence South 67 degrees 18 minutes 12 seconds West, 100.00 feet; thence South 22 degrees 41 minutes 48 seconds East, 95.60 feet; thence Southwesterly along a curve to the right being tangent to the last described course with a radius of 250.00 feet, a central angle of 90 degrees 53 minutes 32 seconds and an arc distance of 396.59 feet; thence South 68 degrees 11 minutes 44 seconds West, 871.15 feet; thence South 70 degrees 13 minutes 25 seconds West, 1,399.92 feet; thence Northwesterly along a curve to the right being tangent to the last described course with a radius of 250.00 feet, a central angle of 120 degrees 06 minutes 04 seconds and an arc distance of 524.04 feet; thence North 10 degrees 19 minutes 29 seconds East, 1,659.25 feet; thence North 15 degrees 13 minutes 01 seconds East, 675.01 feet; thence North 34 degrees 18 minutes 02 seconds West, 211.74 feet; thence Northerly along a curve to the right having an initial tangent bearing of North 34 degrees 05 minutes 38 seconds West with a radius of 671.85 feet, a central angle of 18 degrees 24 minutes 42 seconds and an arc distance of 215.90 feet; thence North 55 degrees 56 minutes 32 seconds East, 331.69 feet to a point on the aforesaid Southerly right of way line of Missouri State Highway No. 150; thence Easterly on said Southerly right of way line the following seven (7) courses: thence South 86 degrees 24 minutes 47 seconds East, 918.52 feet; thence South 82 degrees 07 minutes 26 seconds East, 131.60 feet; thence South 86 degrees 24 minutes 47 seconds East, 114.83 feet; thence North 87 degrees 29 minutes 54 seconds East, 247.46 feet; thence South 86 degrees 24 minutes 47 seconds East, 183.73 feet; thence South 67 degrees 58 minutes 41 seconds East, 51.87 feet; thence South 86 degrees 24 minutes 47 seconds East, 6.93 feet to the Point of Beginning. Containing 6,017,085 square feet or 138.133 acres, more or less.

 

subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 88, Code of Ordinances of the City of Kansas City, Missouri, as amended, commonly known as the Development Regulations.

 

2. That the developer provide a detailed micro storm drainage study showing compliance with the approved and most current macro study on file with the City and with current adopted standards in effect at the time of submission, including a detailed analysis and design of the permanent water quantity and water quality BMP’s conveyance systems and sewer services, prior to approval and issuance of any building permits to construct improvements on the site; that the developer verify and/or improve downstream conveyance systems or address solutions for impacted properties due to flow contributions from the site; and that the developer construct any other improvements as required by the Land Development Division as necessary to mitigate impacts from rate, volume and quality of runoff from the proposed site.

 

3. That the developer obtain the executed and recorded City-approved grading, temporary construction, drainage/sewer, or any other necessary easements from the abutting property owner(s) that may be required prior to submitting any public improvements crossing properties not controlled by the developer and include said document(s) within the public improvement applications submitted for permitting. 4. That the developer submit plans for grading, siltation and erosion control to the Land Development Division for approval prior to beginning any construction activities, clearing or grubbing activities, if the disturbed area equals one acre or more during the life of the construction activity. 5. That the owner/developer secure a site disturbance permit from the Land Development Division prior to beginning any construction, grading, clearing, or grubbing activities, if the disturbed area equals one acre or more during the life of the construction activity. 6. That after the City Plan Commission enters its disposition for the development plan, the developer shall not enter into any agreement that would encumber or otherwise have any impact on the proposed right of way dedications for the planned project without the prior written consent of the Land Development Division.

 

7. That the developer grant, on City approved forms, BMP Easements to the City, as required by Chapter 88 and Land Development Division, prior to issuance of any building permits or BMP permits, whichever occurs first. 8. That the owner/developer verify adequate capacity of the existing sewer system as required by the Land Development Division for the property and address any inadequacies therein prior to issuance of connection authorization and/or issuance of any temporary certificate of occupancy (TCO).

 

9. That the developer dedicate right-of-way for public street improvements within the final plat boundary as required by the Land Development Division and that the developer submit public improvement plans, including intersection improvements, public streets and storm sewers, sanitary sewers, streetlights, road markings, sidewalk, curb and gutter and drive approaches, as applicable, to address all above items direct to the Land Development Division for code compliance review and obtain all required construction permits from the Land Development Division. 10. That the developer subordinate to the City all private interest in the area of any right-of-way dedication, as required by Development Services, and that the developer shall be responsible for all costs associated with subordination activities now and in the future.

 

11. That the developer provide a storm water conveyance system to serve all proposed lots within the development and determine adequacy as required by the Land Development Division.

 

12. That the developer submit covenants, conditions, and restrictions for approval by the City for the maintenance of any private open spaces and any detention areas and enter into a covenant agreement for the maintenance of any stormwater detention area tracts, with each final plat.

 

13. That the developer provide copies of the executed and recorded Surface Drainage Easements. These easements may be identified with book and page numbers on the plat but they cannot be dedicated by the final plat. Separate documents must be submitted to Development Services. 14. That the developer must secure permits to extend sanitary and storm water conveyance systems to serve all proposed lots or across jurisdictional boundaries within the development and determine adequacy of receiving systems as required by the Land Development Division, prior to recording the plat or issuance of a building permit whichever occurs first.

 

15. That the developer pay impact fees as required by Chapter 39 of the City's Code of Ordinances, as required by the Land Development Division.

 

16. That the developer provide for fire protection as required by the Fire Department prior to construction beyond foundations.

 

17. That the developer extend water mains and grant exclusive 25 foot easements as required by the Water Services Department.

 

18. That the developer secure the approval of the Missouri Highway and Transportation Department for any work within State right of way.

 

19. That the developer secure approval of the Street Naming Committee for all street names if addressing of the property from the new access road is desired.

 

20. That the developer dedicate an additional 12 feet of right-of-way on the west side of Botts Road from 149th Street to a point 300 feet north of 149th Street at the time of platting of the adjacent parcel or as required by future approved amendments to the traffic impact study.

 

21. That the developer dedicate an additional 6 feet of right-of-way on the north side of 149th Street from Botts Road to a point 250 feet west of Botts Road at the time of platting of the adjacent parcel or as required by future approved amendments to the traffic impact study.  

 

22. That the developer dedicate an additional 6 feet of right-of-way on the south side of 149th Street from Botts Road to a point 250 feet west of Botts Road at the time of platting of the adjacent parcel or as required by future approved amendments to the traffic impact study.

 

23. That the developer install a traffic signal at the intersection of Botts Road and 149th Street at such time that the Public Works Department determines that traffic signal warrants are met.  

 

Section C. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
