ORDINANCE NO. 080313

 

Authorizing the Director of Water Services to execute a Cooperative Agreement with BT Residential, LLC to provide for payment of additional costs associated with an increase in flow capacity to a wastewater pump station in the vicinity of Green Hills Road and N.W. 96th Street; and recognizing this as an emergency.

 

WHEREAS, the Water Services Department is constructing a wastewater pump station; and

 

WHEREAS, BT Residential, LLC (the Developer) owns property adjacent to the wastewater pump station and intends to develop its property, including the construction of sewers that will flow to the pump station; and

 

WHEREAS, the pump station is not designed to accommodate the increased flow of wastewater from the Developers property; and

 

WHERAS, the Developer is willing to pay the Water Services Department the cost of increasing the pump station capacity to accommodate its contributed flow; and

 

WHEREAS, the purpose of this ordinance is to authorize a Cooperative Agreement between the Water Services Department and the Developer related to increasing the pump stations capacity to handle the increased flow of wastewater from the Developers property; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the Director of Water Services is hereby authorized to execute a Cooperative Agreement with BT Residential, LLC, in substantial form as is on file in the Office of the Director of the Water Services Department, to provide for the additional costs associated with an increase in flow capacity to the wastewater pump station in the vicinity of Green Hills Road and N.W. 96th Street.

 

Section 2. That this ordinance is recognized as an emergency measure within the provisions of Section 503 of the City Charter in that it relates to a public improvement, and shall take effect in accordance with that section.
