COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 920379, AS AMENDED

 

Amending Chapter 21 of the Code of General Ordinances, Licenses and Miscellaneous Business Regulations, Article IV, Vehicle Licenses, by repealing Section 21.410 and enacting in lieu thereof a new section to be known as Section 21.410 License Fees relating to the same subject; submitting such license fees and charges to the qualified electors of Kansas City, Missouri, for their approval or disapproval at the next General Election to be held in said City August 4, 1992, pursuant to the requirements of Article X, Section 22, Constitution of Missouri; and recognizing this as an emergency measure.

 

WHEREAS, Article X, Section 22, Constitution of Missouri, the "Hancock" Amendment, prohibits political subdivisions from levying any new tax, license or fee or from increasing any existing tax, license or fee without the approval of a majority of the voters thereon; and

 

WHEREAS, the General Assembly amended Section 301.340 R.S.Mo. 1985 allowing the voters of a municipality to establish a uniform municipal vehicle license fee for all motor vehicles; and

 

WHEREAS, additional revenues must be produced to provide for the adequate maintenance, adornment, construction, repair and operation of the City's parks, parkways, boulevards, community centers and other properties under the control and management of the Board of Parks and Recreation Commissioners; and

 

WHEREAS, the Citizens Budget Review Commission, in its January 1991 report, recommended instituting a flat fee for City Vehicle Licenses with the collection function being transferred to the counties; and

 

WHEREAS, the Board of Parks and Recreation Commissioners by Resolution No. 21747 has requested that the Council submit to the voters of Kansas City a proposition instituting a flat fee for motor vehicle license fees; and

 

WHEREAS, by this Ordinance, the Council has approved a flat fee for various motor vehicle license fees to become effective after the approval by the electorate; and

 

WHEREAS, the loss to the general fund as a result of the city sticker processing will be made up from the designated zoo admission funds not to exceed 1.9 million; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That the Code of General Ordinances of Kansas City, Chapter 21, Licenses and Miscellaneous Business Regulations, Article IV, Vehicle Licenses, Section 21.410, generally, is hereby amended by repealing Section 21.410 and enacting in lieu thereof a new section of like number and subject matter to read as follows:

 

 

 

Section 21.410. License Fees.

 

(a) License, fee. Every person residing in the city, who is the owner of a motor vehicle, except a motor vehicle used

 

exclusively outside the city, shall, before permitting the operation of such vehicle upon the streets of the city, procure a license thereon for each motor vehicle so owned. The amount of license fees to be paid therefor shall be as follows:

 

(1) For each motor vehicle or commercial motor vehicle $12.50

 

(b) "Owner" defined. The term "owner", as used herein,

shall include any person owning or renting a motor vehicle, or having the exclusive use thereof under lease or otherwise for a period greater than ten (10) days successively.

 

Section B. This ordinance, upon approval by a majority of the voters voting thereon, shall take effect as of the date of approval by the electorate.

 

Section C. That pursuant to the provisions of Article X, Section 22, Constitution of Missouri, establishment of a uniform motor vehicle license fee shall be submitted to the qualified electors of Kansas City for their approval or disapproval at the election to be held August 4, 1992. The proposition shall read as follows:

SHALL THE FOLLOWING BE APPROVED

 

Abolishing the current City sticker, setting a uniform license fee of $12.50 for each motor vehicle or commercial motor vehicle as set forth in Section 21.410 of the General Ordinance of Kansas City to be collected by the respective County collectors. Such fee, license and charge for vehicle licenses as set forth in Section 21.410, General Ordinances of Kansas City shall be effective immediately upon approval by a majority of the electors voting thereon with the revenues derived from the vehicle licenses, shall be dedicated annually as follows:

 

(a) necessary revenues to the Counties as payment for

the collection service,

 

(b) for continued Park maintenance operations, as in the

current City Vehicle License plan,

 

(c) for construction and renovation of Community

Centers,

 

(d) for operation of new Community Centers,

 

YES

 

NO

 

The voter who desires to vote in favor of the proposition shall place an X in the box opposite YES. The voter who desires to vote against the proposition shall place an X in the box opposite NO.

 

If a majority of the qualified voters voting at said election shall vote in favor of the approval of the foregoing proposition, then it shall become effective immediately for a period of twenty years.

 

Section D. The City Clerk shall deliver to the Board of Election Commissioners of Kansas City, Missouri, to the Board of Election Commissioners of Clay County, Missouri, to the Clerk of the County Court of Platte County, Missouri, to the Clerk of the County Court of Cass County, Missouri, each a certified copy of this Ordinance which shall be the authority for said respective election authorities of said City to conduct said election, provide the ballot labels and ballots therefor, give notice thereof according to law and certify the results thereof.

 

Section E. This Ordinance, providing for the submission of a proposal to the people, is recognized to be an emergency measure within the provisions of Section 15, Article II of the Charter and shall take effect immediately upon passage.
