RESOLUTION NO. 120222

 

Amending the Westport Land Use Plan by amending the Proposed Land Use Plan and Map for approximately about 2 acres generally located on the east half of the block bounded by W. 39th Terrace on the north, W 40th Street on the south, Broadway on the west and Central Street on the east from one/two family residential to multifamily residential high density. (132-S-38)

 

WHEREAS, on August 11, 1972, the City Council through the adoption of Resolution No. 41438 which adopted the Westport Planning Area Plan as a plan for future development within an area generally bounded on the north by 31st Street Trafficway, on the west by State Line Road, on the south by Ward Parkway and on the east by Troost Avenue; and

WHEREAS, due to certain changes, it is desirable to modify certain components of the Westport Planning Area Plan by an amendment to the Land Use Plan and Map as it affects approximately 2 acres generally located on the east half of the block bounded by W 39th Terrace on the north, W 40th Street on the south, Broadway on the west and Central Street on the east from one/two family residential to multifamily residential high density.

 

WHEREAS, public notice of a hearing before the City Plan Commission was published on January 23, 2012; and

 

WHEREAS, the City Plan Commission considered such amendment to the Land Use Plan and Map on February 7, 2012; and

 

WHEREAS, after all interested persons were given an opportunity to present testimony, the City Plan Commission did on February 7, 2012, recommend approval of the proposed amendment to the Westport Planning Area Plan; NOW, THEREFORE,

 

BE IT RESOLVED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That the Westport Planning Area Plan is hereby amended by repealing the Land Use Plan and Map and approving a new Land Use Plan and Map which changes the recommended land uses for 2 acres generally located on the east half of the block bounded by W. 39th Terrace on the north, W. 40th Street on the south, Broadway on the west and Central Street on the east from one/two family residential to multifamily residential high density. A copy of the amendment to the Westport Planning Area Plan is attached hereto as Exhibit “A” and is incorporated herein by reference.

 

Section B. That the amendment to the Westport Planning Area Plan is consistent and complies with the FOCUS Kansas City Plan, adopted on October 30, 1997, by Committee Substitute for Resolution No. 971268, and is adopted as a supplement to the FOCUS Kansas City Plan.

 

Section C. That the Council finds and declares that before taking any action on the proposed Westport Planning Area Plan hereinabove, all public notices have been given and hearings have been had as required by law.
