COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 120519

 

Amending Committee Substitute for Ordinance No. 120099, by repealing Sections 2 and 3, and enacting in its place new Sections 2 and 3; approving and authorizing the Director of City Development to enter into a subgrant agreement with Ivanhome, a Missouri non-profit corporation, in an amount not to exceed $407,128.00 to fund authorized abatement activities at the Horace Mann School building located at 2008 E. 39th Street, Kansas City, Missouri; and waiving the local cost share requirement for the subgrant.

 

WHEREAS, Committee Substitute for Ordinance No. 120099 approved a subgrant in the amount of $378,128.00 from the Kansas City Brownfield Revolving Loan Fund (Kansas City BRLF) program for the remediation of the Horace Mann School building subject to certain preconditions, including a requirement that Ivanhome provide a 20% cost share from the proceeds of an insurance claim on the building; and

 

WHEREAS, the ARRA Revolving Loan Fund Grant, Federal Cooperative Agreement No. 2B-97708801, which provides a portion of the funds for the subgrant, requires that all funded work be completed and paid by September 30, 2012, and there is a significant risk that the subgrant recipient, Ivanhome, will be unable to secure the required cost share in time to meet the grant deadline; and

 

WHEREAS, the work plan to implement the Brownfields Revolving Loan Fund Grant, Federal Cooperative Agreement No. BF-97700901, allows the City to waive the local cost share requirement for a subgrant recipient if the City believes it can identify additional local cost share for another brownfields revolving loan fund loan or subgrant project sufficient to make up the waived amount; and

 

WHEREAS, the City has identified bond proceeds appropriated for another Brownfields revolving loan fund subgrant project, the 63rd and Prospect Redevelopment Project, as approved by Ordinance No. 120348, that will provide additional local cost share sufficient to make up the waived amount for the Horace Mann School project; and

 

WHEREAS, an increase in the amount of the subgrant by $29,000.00 is required to complete the remediation work plan as approved by the Missouri Department of Natural Resources; and

 

WHEREAS, unless the local cost share precondition is waived and the amount of the subgrant is increased, there is a substantial risk that the Horace Mann Building will not be abated and the ARRA Revolving Loan Fund Grant funds approved for the project will expire unspent; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That Committee Substitute for Ordinance No. 120099 is hereby amended by repealing Sections 2 and 3 and enacting new Sections 2 and 3 in its place to read as follows:

 

Section 2. That a subgrant to Ivanhome from the ARRA Revolving Loan Fund Grant, Federal Cooperative Agreement No. 2B-97708801, in the amount of up to $143,994.00, and a subgrant from the Brownfields Revolving Loan Fund Grant, Federal Cooperative Agreement No. BF-97700901, in the amount of up to $263,134.00, for asbestos abatement, debris removal and stabilization of third floor walls is hereby approved, provided that prior to entering into any subgrant agreement or providing any subgrant funds, the following pre-contractual requirements are undertaken and are confirmed in writing to the City, within 160 days of the effective date of this Ordinance:

 

(a)    EPA approve a waiver of the $200,000.00 per project limit on subgrant assistance; and

 

(b)   Ivanhome meets all other eligibility requirements, for Kansas City BRLF assistance, whether imposed by the City or EPA.

 

Section 3. That upon satisfaction of the pre-contractual requirements in Section 2 above, the Director of City Development is hereby authorized to enter into a subgrant agreement with Ivanhome to subgrant funds from the Kansas City BRLF in a total amount not to exceed $407,128.00 for the abatement and removal of eligible debris from Horace Mann School, from funds previously appropriated to the following accounts:

TOTAL $407,128.00

 

A copy of the agreement, in substantial form, is on file with the office of the Director of City Development.

 

Section 2. That any local cost share precondition is waived for purposes of this subgrant.

I hereby certify that there is a balance, otherwise unencumbered, to the credit of the appropriation to which the foregoing expenditure is to be charged, and a cash balance, otherwise unencumbered, in the treasury, to the credit of the fund from which payment is to be made, each sufficient to meet the obligation hereby incurred.
