ORDINANCE NO. 200282

 

Declaring certain real property generally located in the Beacon Hill Redevelopment Area in Kansas City, Missouri, surplus to the City's needs; authorizing the Director of General Services to offer the sale of the City’s interest in this real property in accordance with City regulations, to later convey it and to execute related documents to complete the transfer of the real property to continue development of the Beacon Hill project.

 

WHEREAS, the City owns rights in certain real property generally located at 2438 and 2442 Tracy Avenue, and along the east side of Lydia from 22nd to 23rd Streets, more fully described below, in Kansas City, Missouri; and

 

WHEREAS, the City Manager has determined on behalf of all City departments that the parcels of real property set out below are in excess to the needs of the City and no interest has been expressed by any City department in retaining the land for public use; and

 

WHEREAS, these properties in the Beacon Hill project area have been identified for redevelopment by the City Manager and thus are surplus to the City’s needs; and

 

WHEREAS, a Request for Qualifications and Proposals was issued by the City on October 12, 2018, for redevelopment of the properties; and

 

WHEREAS, certain recorded easements affecting the real property, but benefitting the City, shall remain in effect and any conveyance out of the City shall be specifically subject to existing recorded easements and encumbrances, and dedicated right of way for public streets, which shall be deemed retained by the City, as more fully set forth in the subsequent transfer deed; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the property described below, is hereby declared surplus to the City’s needs.

 

Section 2. That the Director of General Services Department is hereby authorized to offer and sell, in accord with City regulations and made available through an open and public competition, the City’s rights in the properties, which is legally described as follows:

 

2438 Tracy Ave - N 12.5', Lot 22, Hall’s Hill, a subdivision in Kansas City, Jackson County, Missouri, according to the recorded plat thereof. Commonly known as 2438 Tracy Avenue, Kansas City, Jackson County, Missouri.


2442 Tracy Ave - N 12.5 feet Lot 21 s 37.5 feet Lot 22, Block 3 Hall’s Hill, a subdivision in Kansas City, Jackson County, Missouri, according to the recorded plat thereof. Commonly known as 2442 Tracy Avenue, Kansas City, Jackson County, Missouri.

Section 3. That certain easements or other encumbrances of record are being retained on behalf of the City and will be expressly listed as retained on the Special Warranty Deed to be executed by the City so as to subject such conveyance to such easements and encumbrances.

 

Section 4. That as a part of the request for proposal process, the General Services Department staff shall require a proposer to provide a scope of work to construct new, residential housing with a construction timeline, and identify sources of funding for such construction, with the General Services Department staff obtaining security for the completion of such construction commitments in a form determined appropriate by such Director, including without limitation, a performance deed of trust.

 


Section 5. That the Director of General Services is hereby authorized to execute any real estate or other documents needed to effectuate the transaction described herein.
