Approving
a Community Unit Project on an approximately 16.0 acre tract of land generally located
approximately 670 feet north and 815 feet west of the intersection of N.W. 68th
Street and N. Platte Purchase Drive (N. Bell Street). (12389-CUP-2)

IT ORDAINED BY THE COUNCIL OF KANSAS CITY:
Section
A. That a Community Unit Project on an approximately 16.0 acre tract of land
generally located approximately 670 feet north and 815 feet west of the
intersection of N.W. 68th Street and N. Platte Purchase Drive (N. Bell Street),
and more specifically described as follows:
Beginning at a point 165 feet west of the East
Quarter corner of Section 21, Township 51, Range 33, Kansas City, Platte
County, Missouri, thence North 00E32'24"
East, a distance of 89.84 feet to the point of beginning; thence South 89E35'03" East, a distance of 150.00.56
feet; thence North 00E32'24" East, a
distance of 53.67 feet; thence North 04E38'32"
East, a distance of 69.89 feet; thence North 00E32'24" East, a distance of 66.10 feet to
the beginning of a curve to the left having a radius of 200.00 feet; thence
northwardly feet along said curve, a distance of 9.39 feet; thence South 89E27'36" East, a distance of 443.86
feet; thence North 00E32'24" East, a
distance of 138.23 feet to the beginning of a curve to the right having a
radius of 300.00 feet; thence northeastwardly along said curve, a distance of
471.24 feet; thence South 89E27'36"
East, a distance of 68.35 feet; thence North 00E32'24" East, a distance of 365.05 feet;
thence North 89E49'10" West, a
distance of 802.01 feet; thence North 00E32'24"
East, a distance of 224.54 feet; thence North 89E18'24" West, a distance of 165.00 feet;
thence South 00E32'24" West, a
distance of 1220.43 feet to the point of beginning. Containing 16.009 acres,
more or less.
is
hereby approved, subject to the following conditions:
1. That
the developer cause the area to be platted and processed in accordance with
Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, as
amended, commonly known as the Subdivision Regulations.
2. That
the developer submit a storm drainage study for the entire development to the
City Engineers Office for approval when the first final plat is submitted and
that the developer construct any improvements as required by the City
Engineers Office.
3. That
the developer submit plans for grading and siltation and erosion control to the
City Engineer's Office for approval prior to beginning any construction
activities.
4. That
the developer secure a land disturbance permit from the Department of Public
Works prior to beginning any construction, grading, clearing or grubbing
activities, if the disturbed area exceeds one acre.
5. That the developer secure a
land disturbance permit from the Missouri Department of Natural Resources.
6. That the developer dedicate
additional right of way for N. Platte Purchase Drive as required by the
Department of Public Works so as to provide a total of 40 feet of right of way
as measured from the centerline of N. Platte Purchase Drive.
7. That the developer improve the
west half of N. Platte Purchase Drive to secondary arterial street standards as
required by the Department of Public Works, including construction of curb,
gutter and sidewalks and installation of streetlights, or enter into an
agreement with the City as required by the Department of Public Works whereby
the developer contributes $48,648.70 for the improvement of N. Platte Purchase
Drive based on a rate of $134.00 per front foot.
8. That the developer contribute
$3,423.20 in lieu of parkland dedication for 16 single-family units and 96
multi-family units (1.5 acres less 1.24 acres of private open space provided at
the rate of $12,811.37 per acre) in satisfaction of Section 66-128 of the
Subdivision Regulations.
9. That the developer secure the
approval of the Board of Zoning Adjustment for any subdivision identification
signage.
10. That the developer submit a
street name signage plan to the Street Naming Committee for approval prior to
the submittal of the first final plat.
11. That the developer submit a
Certificate of Survey to the Department of City Development for approval prior
to sale of individual units.
12. That the developer extend water
mains as required by the Water Services Department.
13. That the developer extend
sanitary sewers as required by the Department of Public Works.
14. That the developer construct
all-weather roads and provide for fire protection as required by the Fire
Department prior to construction beyond footings and foundations.
15. That the developer submit
covenants, conditions and restrictions to the Law Department for approval for
the maintenance of private open spaces and any detention areas within the final
plat.
16. That the developer submit a
street tree planting plan as part of the final plat with a copy to be submitted
to the Department of City Development, secure the approval of the City Forester
for street trees planted on right of way in front of residential lots, and
plant the street trees in conformance with the plan approved by the City
Forester. The plan shall include size, type, species and placement of trees.
17. That the developer submit a
final plan to the City Plan Commission for approval, including plans for
landscaping, grading, signage, screening, berming and fencing.
A copy of said Community Unit
Project plan is on file in the office of the City Clerk under Document No.
001222, which is attached hereto and made a part hereof.
Section B. That
the Council finds and declares that before taking any action on the proposed
Community Unit Project hereinabove, all public notices and hearings required by
the Zoning Ordinance have been given and had.
